Abstract

Persyaratan jual beli dan atau pelepasan hak di Kantor Pertanahan diperlukan persetujuan semua ahli waris atau semua pemegang hak atas sertipikat tersebut, akan tetapi dari pemegang hak di antaranya masih di bawah umur, oleh karena anak pemohon masih di bawah umur maka tidak cakap bertindak hukum sendiri. Dengan demikian tidak dapat dilakukan oleh anak-anak yang masih di bawah umur. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif yang dilakukan untuk menelaah dan menganalisa data sekunder sebagai sumber utama yang didukung dengan penelitian lapangan. Dari hasil penelitian diperoleh Kepastian hukum jual beli hak milik atas tanah karena pewarisan yang salah satunya masih dibawah umur adalah adanya kepastian hukum dengan mengajukan penetapan perwalian dan izin menjual tanah ke pengadilan. Setelah dikeluarkannya penetapan perwalian dan izin menjual tanah dari Pengadilan Negeri pemohon dapat melakukan perbuatan hukumnya menjual tanah warisannya sesuai dengan syarat yang telah diatur Pasal 359 KUHPerdata, Pengadilan Negeri harus mengangkat seorang wali,. Pasal 393 KUHPerdata, untuk menjual sesuatu barang maka wali harus terlebih dahulu mendapat ijin dari pengadilan. Dengan dikeluarkannya Penetapan Perwalian dan Izin menjual tanah dari Pengadilan maka pemohon dapat melakukan perbuatan hukum mewakili anaknya yang masih di bawah umur untuk menandatangani AJB dihadapan PPAT. / The terms of sale and purchase and or release of rights at the Land Office require the approval of all heirs or all rights holders for the certificate, but some of the rights holders are minors, because the applicant's child is underage, so he is not capable of acting independently. Thus it cannot be done by children who are underage. The method used in this research is normative legal research which is conducted to examine and analyze secondary data as the main source which is supported by field research. From the results of the research, it was obtained legal certainty of buying and selling land ownership rights due to inheritance, one of which is still underage is the existence of legal certainty by submitting a guardianship stipulation and permission to sell land to the court. After the issuance of the stipulation of guardianship and permission to sell land from the District Court, the applicant can carry out his legal actions by selling his inherited land in accordance with the conditions stipulated in Article 359 of the Civil Code, the District Court must appoint a guardian. Article 393 of the Civil Code, in order to sell something, the guardian must first obtain permission from the court. With the issuance of a Guardianship Decree and Permit to sell land from the Court, the applicant can take legal action on behalf of his minor child to sign the AJB before the PPAT.
