Abstract

Merek merupakan suatu karya intelektual yang dapat dikategorikan sebagai aset tidak berwujud yang membutuhkan perlindungan hukum melalui pendaftaran. Hak eksklusif atas penggunaan merek terdaftar di Indonesia diberikan berdasarkan prinsip first to file system sesuai dengan sistem konstitutif. Sejauh ini, masih banyak pelaku usaha tekstil tidak mendaftarkan merek dagangnya ke Direktorat Jenderal Kekayaan Intelektual. Hal itu mengakibatkan permasalahan hukum dalam industri dan perdagangan tekstil yang merupakan salah satu sektor andalan bagi Indonesia karena dapat memberikan kontribusi yang besar terhadap perekonomian nasional. Penelitian ini bertujuan untuk mengkaji dan menganalisis pengaturan mengenai pendaftaran merek di Indonesia dan implementasi dari pengaturan pendaftaran merek dalam perdagangan produk tekstil di Indonesia. Bentuk penelitian bersifat normatif dengan menggunakan dukungan verifikasi empiris serta dengan pendekatan perundang-undangan, konseptual dan historis. Dalam penelitian ini ditemukan bahwa masih banyak kendala dalam proses administrasi pendaftaran merek di Indonesia. Selain itu, implementasi pengaturan pendaftaran merek produk tekstil di Indonesia masih mengalami banyak penyimpangan akibat dari persaingan usaha tidak sehat, terutama yang didasari oleh motif itikad tidak baik dan pelaku usaha yang mendapatkan dukungan dari aparat yang tugasnya terkait dengan pendaftaran merek. / A trademark refers to an intellectual work that can be categorized as an intangible asset where it requires legal protection through registration. Exclusive rights to use a registered trademark in Indonesia are granted based on the principle of the first-to-file system in accordance with the constitutive system. Until today, many textile business actors do not register their trademarks to the Directorate General of Intellectual Property. These phenomena resulted in legal issues as the textile industry and trade is one of Indonesia's mainstay sectors where it can significantly contribute to the national economy. This study aims to examine and analyze the regulation of trademark registration in Indonesia and the implementation of the regulation of trademark registration in the trade of textile products in Indonesia. This research is a normative by using statutory, conceptual, and historical approaches as well as empirical verification support. This study found that there are still many obstacles in the administrative process of trademark registration in Indonesia. In addition, the implementation of the regulation on the registration of textile product trademarks in Indonesia still needs to be improved due to unfair business competition with bad faith motives and business actors who receive support from officials who have the authority related to trademark registration.
