Abstract

Indonesia is a country that is still shrouded in problems related to land disputes and it can be said that these problems are chronic and classic. Until now, land issues in Indonesia have caused many conflicts, both social and legal. Land conflicts usually arise due to uncertainty about the status of existing land in the local area. Law as commander-in-chief in this matter must provide definite rules in order to create a good ecosystem for land management in Indonesia. In addition to law as commander in chief, it is hoped that law can move the government so that it can intervene in land issues in Indonesia. From the background mentioned above, then the problem arises as to what causes land registration which is recognized by customary law communities as customary property rights in Labuan Bajo and how to resolve disputes over customary land ownership in Labuan Bajo. This study also aims to describe and analyze the causes of land registration recognized by indigenous peoples as customary property rights in Labuan Bajo and to describe and analyze the settlement of disputes over customary land in Labuan Bajo. The type of research used in this study is empirical juridical legal research. The results of the research on the causes of land registration which are recognized by customary law communities as customary property rights in Labuan Bajo are the non-creation of the principle of security in land registration, the lack of integrity values that occur during the employee recruitment process, the approach of elements of power and the weakness of the position and legal certainty of indigenous peoples in matters of customary land. Settlement of customary land disputes in Labuan Bajo can be carried out in two ways, namely non-litigation settlement, namely negotiation, conciliation, mediation and arbitration. While litigation can be pursued through the district/general court route and the state administrative court route. / Indonesia merupakan Negara yang masih diselimuti persoalan yang berkaitan dengan perebutan tanah dan dapat dikatakan bahwa permasalahan ini bersifat kronis dan klasik. Masalah pertanahan di Indonesia sampai saat ini banyak menimbulkan konflik baik sosial maupun hukum. Konflik pertanahan biasanya timbul karena ketidakpastian terhadap status tanah yang ada di daerah setempat. Hukum sebagai panglima tertinggi dalam hal ini harus memberikan aturan yang pasti supaya tercipta ekosistem yang baik untuk pengelolaan tanah di Indonesia. Selain hukum sebagai panglima tertinggi, diharapkan hukum dapat menggerakan pemerintah supaya dapat memberikan intervensi terhadap permasalahan pertanahan di Indonesia. Dari latar belakang tersebut di atas maka kenudian muncul permasalahan apa penyebab terjadinya pendaftaran tanah yang diakui oleh masyarakat hukum adat sebagai hak milik adat di Labuan bajo dan bagaimana penyelesaian sengketa tanah milik adat di Labuan Bajo. Penelitian ini juga bertujuan untuk menggambarkan dan menganalisis penyebab terjadinya pendaftaran tanah yang diakui oleh masyarakat hukum adat sebagai hak milik adat di Labuan Bajo serta menggambarkan dan menganalisis penyelesaian sengketa tanah milik adat di Labuan Bajo. Jenis penelitian yang digunakan dalam penelitian ini adalah penelitian hukum yuridis empiris. Hasil penelitian penyebab terjadinya pendaftaran tanah yang diakui oleh masyarakat hukum adat sebagai hak milik adat di Labuan Bajo yakni tidak terciptanya asas aman dalam pendaftaran tanah, kurangnya nilai integritas yang terjadi pada saat proses perekrutan pegawai, oknum pendekatan kekuasaan serta lemahnya kedudukan dan kepastian hukum masyarakat adat dalam persoalan tanah ulayat. Penyelesaian sengketa tanah milik adat di Labuan Bajo dapat dilakukan dengan dua jalur yaitu penyelesaian dengan cara non litigasi yakni negosiasi, konsiliasi, mediasi, dan artbitrase. Sedangkan litigasi dapat ditempuh melalui jalur pengadilan negeri/umum dan jalur pengadilan tata usaha Negara.
