Abstract

Hak milik atas tanah sangat penting bagi negara, bangsa dan rakyat sebagai masyarakat yang sedang membangun ke arah perkembangan industri. Notaris adalah pejabat umum (openbare ambtenaren), karena erat hubungannya dengan wewenang atau tugas dan kewajiban yang utama yaitu membuat akta-akta autentik. Oleh karena itu, penelitian ini dilakukan untuk mengetahui tanggung jawab Notaris terkait Penyelundupan Hukum pada pembuatan Akta Nominee untuk Warga Negara Asing dan juga kepemilikan Hak atas Tanah terdaftar yang berasal dari Akta Nominee ditinjau dari Kitab Undang-Undang Hukum Perdata.Penelitian ini adalah penelitian yuridis normatif.Penelitian ini menggunakan pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus.Dari hasil penelitian tersebut, dapat disimpulkan bahwa tanggung jawab notaris dalam pembuatan aktanomineepada umumnya dikaitkan dengan sanksi hukum yang dapat dibedakan menjadi tiga macam pertanggungjawaban yaitu tanggung jawab secara hukum perdata, tanggung jawab secara hukum pidana dan tanggung jawab administrasi. Kepemilikan hak atas tanah tetap berada pada pemegang hak atas tanah yang namanya terdaftar dalam sertifikat dan tidak mengakui kedudukan Warga Negara Asing sebagai pemilik hak atas tanah walaupun telah dibuat akta nominee secara notariil. Dengan demikian dapat disimpulkan bahwa perjanjian nominee hak atas tanah bagi warga negara asing merupakan perjanjian yang batal demi hukum, karena telah melanggar syarat objektif yang tertuang dalam ketentuan pada Pasal 1320 Kitab Undang-Undang Hukum Perdata, sehingga perjanjian tersebut dianggap tidak pernah ada sejak perjanjian tersebut dibuat. / In a civiliation moving toward industrial growth, land ownership rights are crucial for the state, the country, and the people. The purpose of this research was to determine, in accordance with the Civil Code, the duties of a Notary with regard to the drafting of Nominee Agreements for Foreign Citiens and the ownership of registered Land Rights resulting from Nominee Agreements. This research, which focuses on the science of law and is classified as normative juridical research. A statutory approach, a conceptual approach, and a case method are all used in this study. Based on the study's findings, it can be said that a notary's responsibility for creating a nominee agreements is typically linked to legal penalties that can be classified into three categories: responsibility under civil law, culpability under criminal law, and obligation under a notary'sadministration. Despite the fact that a nominee agreements has been certified, ownership of the land rights remains with the person whose name is listed on the certificate. As a result, it can be said that the nominee agreement on foreign persons' land rights is void since it disregarded the requirements set forth in Article 1320 of the Indonesian Civil Code.
