Abstract

Health is the most important things for human life. There are many ways that human can do to get a healthy body, such as doing sports, consuming nutritious food, taking drugs and supplements. Medicine is an important element in health services. One type of medicine that is still trusted by Indonesian people is traditional medicine. In Indonesia, traditional medicine has been known for a long time. But on the other hand, traditional medicine can be detrimental to health if they do not meet the requirements or when used incorrectly. Traditional medicine must have a distribution permit before being distributed, the permit is issued by BPOM as a supervisory agency. However, until now traditional medicines without distribution permits are still often found. This situation creates unrest among the people as consumer because its rights have been violated. Consumers protection is any effort that guerantees legal certainty to provide consumers rights. Consumers protection not only regulates the rights and obligations of consumers, but also the obligations of business actors. In this research, the author uses law normative research to analyze consumer protection for the distribution of traditional medicines without a distribution permit. The data used are legislation about traditional medicine and the results of interviews with the Head of LOKA POM Tangerang. Based on the results, consumers are protected by Act Number 8 of 1999 concerining Consumers Protection. BPOM has a role to prevent consumers from traditional medicines without a distribution permit by supervising products and advertisements.
