Abstract

Bank merupakan lembaga intermediasi yang berfungsi menghimpun dana dari masyarakat dan kemudian menyalurkannya kembali kepada masyarakat dalam bentuk kredit. Dalam menyalurkan kredit harus dilakukan dengan menerapkan prinsip 5C, prinsip Know Your Curtomer, dan prinsip kehati-hatian (prudential banking principle). Bank harus menekan seminimal mungkin resiko yang mungkin timbul. Salah satu upaya memitigasi resiko tersebut antara lain dengan pembuatan perjanjian kredit secara tertulis dan diikuti perjanjian pengikatan agunan. Untuk kredit dengan resiko yang tinggi Bank mensyaratkan perjanjian kredit dibuat secara Notariil untuk lebih menguatkan Bank ketika akan melakukan pembuktian. Dalam pembuatan akta otentik tersebut Bank membutuhkan jasa Notaris. Namun tidak semua Notaris akan digunakan jasanya oleh Bank, hanya Notaris tertentu yang memenuhi kualifikasi yang ditentukan oleh Bank. Bank akan mengikat Notaris ini dengan suatu perjanjian kerjasama yang menjadi underlying ketika Bank memberikan pekerjaan. Bank kerap melakukan intervensi terhadap kinerja Notaris untuk memastikan akta yang dibuat sesuai dengan standar perjanjian baku dari Bank, sehingga Notaris akan terganggu independensi, kemandirian, dan netralitasnya. Dengan perjanjian kerjasama tersebut Notaris akan condong dan berpihak pada Bank. Perjanjian baku yang dibuat oleh Bank tersebut sudah didesain untuk melindungi kepentingan Bank, dan sebaliknya akan merugikan bagi Debitur. Dalam konsisi seperti ini tidak ada yang dapat dilakukan oleh Notaris, hanya sebatas memberikan advice bagi Debitur bagian mana saja dalam perjanjian kredit yang merugikan bagi kepentingan Debitur. Penelitian hukum normatif-empiris dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil dari penelitian adalah bahwa Bank memperketat seluruh aspek dalam penyaluran kredit untuk melindungi dana Bank karena harus dipertanggungjawabkan kepada masyarakat. Notaris yang sudah bekerjasama dengan Bank memiliki tanggung jawab untuk melaksanakan pekerjaannya sesuai yang diperjanjikan, tanggung jawab tersebut meliputi tanggung jawab pidana, perdata, dan administratif. Dalam perjanjian kredit standar baku dari Bank terdapat klausula yang bertentangan dengan Undang-Undang Perlindungan Konsumen dan Peraturan Otoritas Jasa Keuangan Bagi Debitur yang merasa dirugikan dengan perjanjian baku yang dibuat oleh Bank dapat memintakan pembatalan kepada pengadilan karena perjanjian ini. / Banks are intermediary institutions whose function is to collect funds from the public and then channel them back to the public in the form of credit. In distributing credit, it must be done by applying the 5C principle, the Know Your Curtomer principle, and the prudential banking principle . Banks must minimize the risks that may arise. One of the efforts to mitigate this risk is by making a written credit agreement followed by a collateral binding agreement. For loans with high risk, the Bank requires that the credit agreement be made in a notarial manner to further strengthen the Bank when it will do the proof. In making the authentic deed, the Bank requires the services of a Notary. However, not all Notaries will be used by the Bank, only certain Notaries who meet the qualifications determined by the Bank. The Bank will bind this Notary with a cooperation agreement which becomes the underlying when the Bank assigns the work. Banks often intervene on the performance of the Notary to ensure that the deed is made in accordance with the standard agreement from the Bank, so that the Notary's independence, independence, and neutrality will be disturbed. With the cooperation agreement, the Notary will lean and side with the Bank. The standard agreement made by the Bank has been designed to protect the interests of the Bank, and otherwise will be detrimental to the Debitor. In a situation like this, there is nothing a Notary can do, only to provide advice to the Debitor which part of the credit agreement is detrimental to the interest of the Debitor. Normative-empirical legal research using a statutory approach and a conceptual approach. The result of the research is that the Bank has tightened all aspects of lending to protect the Bank's funds because it must be accountable to the public. Notaries who have collaborated with the Bank have the responsibility to carry out their work according to the agreement, these responsibilities include criminal, civil and administrative responsibilities. In the standard standard credit agreement from the Bank, there is a clause that contradicts the Consumer Protection Act and the Financial Services Authority Regulation. Debitors who feel aggrieved by the standard agreement made by the Bank can request cancellation from the court because of this agreement.
