Abstract
Foreign Exchange (forex) is a form of investment that has recently become a trend for Indonesian citizens. This is due to technological development which eases forex mechanism and the lure that forex can provide big profits. Conventional forex trading would require continuous monitoring of price charts on the monitor screen. This is solved with the use of trading robots, a software that analyse trends and technical and fundamental activities, to facilitate clients transactions. However, the convenience of this transaction is misused by parties who gives false promises to clients of guaranteed returns. Such misuse is possible due to lack of clear and strict regulations and the client’s lack of knowledge on the mechanics and their rights to be involved in the robot’s decision-making process. Thus, this thesis will further analyse relevant regulation and how they have provided protection for clients against the fraudulent scheme as well as the perspective of consensualism principle on client’s ability to give consent prior to entering into a forex trading agreement which involves robot trading.
