Abstract

Notaris adalah Pejabat umum yang berwenang untuk membuat akta otentik dimana akta otentik yang dibuat oleh atau di hadapan Notaris menurut bentuk dan tata cara yang ditetapkan dalam Undang-Undang. Akta yang dibuat Notaris menguraikan secara otentik mengenai semua perbuatan, perjanjian dan penetapan yang disaksikan oleh para penghadap dan saksi-saksi. Dalam Putusan Pengadilan Tinggi Denpasar Nomor 35/PID/2020/PT.DPS). Dalam kasus ini yaitu mengenai keterlibatan notaris yang turut serta melakukan pemalsuan akta Perjanjian Pengikatan Jual Beli dan akta Kuasa Menjual Notaris seharusnya memberikan punyuluhan hukum sehubungan dengan perbuatan akta namun Notaris tidak memberikan penyuluhan hukum kepada pihak pembeli dan pelanggaran tersebut berdampak menimbulkan kerugian kepada para pihak yang terkait dengan akta tersebut. Dalam penelitian ini digunakan penelitian Yuridis Normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka. / Notary is a general officer who is authorized to make an authentic deed where an authentic deed is made by or before a Notary according to the form and procedure set forth in the Act. In this study, Normative Juridical research was used, namely legal research conducted by examining library materials.
