Abstract

Based on this research, the writer will talk about the act of doing a cover song on youtube media that is based on the Indonesia Law Number 28 Year 2014 about Copyright. The writer will also put the focus on a song called “Akad” which was sung by the Band Payung Teduh where their song has been used as a cover song by other people without being known by the real singer. Payung Teduh is the copyright holder and they obtain economic rights as the owner of the song. Parties that wants to use this song have a certain limit which is called fair use. The legal issues that will be discussed is whether the fact that performing cover song in youtube can be called as an act of violation of copyright and if the principle of fair use can be used by parties who wants to use somebody else’ song from another owner like Payung Teduh. According to article 23 paragraph (2) a, c,and d, from the book of Law Number 28 Year 2014, copyright parties who does the cover song on youtube must be required to fulfill economic rights to the original performer of the song and that can be by asking a permission request in a form of licenses and accompanied by royalty payment. In this case, Hanindhiya as a youtube has violated the law that contained in the book of copyright Law.
