Abstract

Pendaftaran Tanah Sistematis Lengkap (PTSL) lahir dari Nawacita Pemerintah untuk membangun Indonesia dengan memperkuat daerah dan desa. Kegiatan PTSL yang ada di Kota Samarinda telah dilaksanakan sejak tahun 2017. Namun, karena penerapan dasar hukum yang berbeda untuk kegiatan PTSL tahun 2017 dan tahun 2018, maka penelitian PTSL di Kota Samarinda ini ditinjau dari Permen ATR/ BPN No 6/ 2018 Tentang PTSL. Metodologi penelitian menggunakan penelitian hukum normatif dengan pendekatan perundang- undangan. Pengumpulan data Penulis lakukan melalui studi kepustakaan dan dengan melakukan wawancara terbatas Ketua Panitia Ajudikasi Kota Samarinda yang kemudian dianalisis menggunakan analisis data kualitatif. Dari hasil penelitian, PTSL di Kota Samarinda berhasil menerbitkan seluruh target sertipikat sebanyak 10.500 sertipikat pada bidang tanah yang termasuk kluster 1 (satu). Namun, tidak tersedia data bidang tanah yang termasuk kluster 2 (dua), 3 (tiga) dan 4 (empat). Hambatan PTSL berasal dari internal organisasi dan regulasi PTSL itu sendiri yang tidak sejalan dengan peraturan yang lebih tinggi. Terpenuhinya seluruh target penerbitan sertipikat justru belum berhasil mencapai tujuan PTSL sebagaimana amanat Permen ATR/ BPN No 6/ 2018 Tentang PTSL karena masih menyisakan potensi terjadinya sengketa dibidang pertanahan dan masih perlu dilakukan harmonisasi peraturan untuk menjamin kepastian dan perlindungan bagi masyarakat peserta PTSL dan petugas pelaksana PTSL / Complete Systematic Land Registration (Pendaftaran Tanah Sistematis Lengkap /PTSL) was born from the Government’s Nawacita to develop Indonesia by strengthening regions and villages. PTSL activities in Samarinda City have been carried out since 2017. However, due to the application of different legal basis for PTSL activities in 2017 and 2018, the PTSL research in Samarinda City was reviewed from ATR / BPN Regulation Number 6/2018 About PTSL. The research methodology uses are normative legal research with a statutory approach. Data collection through literature study and interviews was limited to the Chairman of the Samarinda City Adjudication Committee which was then analyzed using qualitative data analysis. From the results of the study, PTSL in Samarinda City succeeded in issuing all of the target of 10,500 certificates of certificate on land parcels which included cluster 1 (one). However, there is no land data available that includes clusters 2 (two), 3 (three) and 4 (four). PTSL barriers originate from internal organization and PTSL regulations themselves are not in line with higher regulations. The fulfillment of all certificates issuance targets has not yet succeeded in achieving PTSL objectives as mandated by the ATR / BPN Regulation Number 6/2018 About PTSL because it still leaves potential for disputes in the land sector and harmonization of regulations is still needed to ensure certainty and protection for PTSL participant communities and PTSL implementing officers
