Abstract

Developing States have pursued foreign investment under the Neoliberal economic ambition to boost their national economic growth. The strategy determined to vitalize investments with the help of Multinational Corporations (MNCs) has led the States to open more of their resources, including customary lands. Hectares of lands inhabited by Indonesian indigenous communities have been disputed due to unaccountable land tenure arrangements between foreign investors, the affected indigenous, and the Indonesian State. The exclusivity and partiality of the Indonesian Law, stipulations and regional officials have heightened the conflict, further worsened the indigenous’ livelihood, and extracted more of their inherited prerogatives. Because of the lacking and weak State’s due diligence, the indigenous people of Kerunang and Entapang in West Kalimantan have endured intensive intimidation, exploitation, and criminalization executed by the prevailed Sime Darby Plantation and the State officials. This research aims to comprehend and interpret the nature between the Dayak Hibun and Sime Darby Plantation conflict, namely the actors’ contribution and the influencing factors. A qualitative approach will be utilized in interpreting the case chronology, using both primary and secondary data, under the spectacles of Critical theory. The criticism established toward the Neoliberal economic scheme’s inevitable ramifications toward the indigenous will rigorously direct the research to scrutinize the conflict. Consequently, the pattern of intimidation, discrimination, and exploitation will surface in the aftermath of the Indonesian State’s partiality and exclusivity toward foreign investors. In further criticizing the Neoliberal economic ambition, the research will witness the negligent character of the Indonesian State that would prolong the conflict. Ultimately, the Critical theory will equip this research to construct a detailed observation and discernment of the land tenure conflict between a foreign investor and an indigenous community. / Negara-negara berkembang telah mengusahakan investasi asing, yang berasal dari ambisi ekonomi Neoliberal, untuk meningkatkan pertumbuhan ekonomi nasional mereka. Strategi yang ditentukan untuk menghidupkan investasi dengan bantuan Korporasi Multinasional (MNC) ini telah mendorong negara-negara untuk membuka lebih banyak tanah dan sumber daya mereka, termasuk tanah adat. Berhektar-hektar tanah yang dihuni oleh masyarakat adat Indonesia telah dipersengketakan karena pengaturan penguasaan tanah yang tidak akuntabel antara investor asing, masyarakat adat yang terdampak, dan Negara Indonesia. Eksklusivitas dan keberpihakan hukum Indonesia, peraturan-peraturan yang berlaku, serta pejabat-pejabat daerah telah meningkatkan konflik yang kemudian memperburuk mata pencaharian masyarakat adat dan mengambil lebih banyak hak prerogatif warisan mereka. Akibat kurang dan lemahnya uji tuntas Negara, masyarakat adat Kerunang dan Entapang di Kalimantan Barat mengalami intimidasi, eksploitasi, dan kriminalisasi intensif yang dilakukan oleh Sime Darby Plantation dan para pejabat Negara. Penelitian ini bertujuan untuk menginterpretasikan hakikat konflik Perkebunan Dayak Hibun dan Sime Darby Plantation melalui kontribusi aktor dan faktor-faktor yang mempengaruhinya. Kronologi kasus akan memanfaatkan kacamata teori Kritis. Kritik yang dibuat terhadap konsekuensi yang tak terhindarkan dari skema ekonomi Neoliberal terhadap penduduk asli akan mengarahkan penelitian untuk meneliti konflik tersebut. Akibatnya, pola intimidasi, diskriminasi, dan eksploitasi akan muncul akibat keberpihakan dan eksklusivitas Negara Indonesia terhadap investor asing. Dalam mengkritik ambisi ekonomi Neoliberal lebih lanjut, penelitian ini akan melihat kelalaian Negara Indonesia yang akan memperpanjang konflik. Pada akhirnya, teori Kritis akan membekali penelitian ini untuk mengkonstruksi pengamatan dan penegasan yang mendetail tentang konflik penguasaan lahan antara investor asing dan masyarakat adat.
