Abstract

Di Indonesia, perwujudan terkait dengan pengaturan hubungan antara manusia dengan tanah tersebut terdapat dalam Pasal 33 ayat (3) Undang-undang Dasar Republik Indonesia Tahun 1945 sebagai dasar dikeluarkannya Undang-undang Nomor 5 Tahun 1960 tentang Peraturan Dasar Pokok-Pokok Agraria (“UUPA”). Walaupun secara tegas dijelaskan bahwa Warga Negara Asing tidak dapat menguasai kepemilikan Hak atas Tanah dengan status Hak Milik di Indonesia, pada praktiknya terdapat beberapa Warga Negara Asing yang dapat mengalahkan sistem peraturan perundang-undangan di Indonesia dengan membuat suatu perjanjian nominee atau dapat juga disebut sebagai perjanjian pinjam nama dengan objek dalam perjanjian tersebut adalah Hak Milik. Kepemilikan tanah dan bangunan yang dapat dimiliki Warga Negara Asing selama berada di Indonesia hanya sebatas pada Hak Pakai, Hak Sewa, Hak Milik atas Saturan rumah susun dan Rumah tempat tinggal atau hunian. Warga Negara Asing di Indonesia tidak diperbolehkan untuk menguasai hak atas dengan status tanah Hak Milik, Hak Guna Bangunan dan Hak Guna Usaha. Mengenai perjanjian nominee yang dibuat oleh Warga Negara Asing dan Warga Negara Indonesia untuk jual beli tidak memenuhi salah satu syarat sahnya perjanjian yakni suatu sebab yang halal, yang secara tidak langsung dilarang dalam Pasal 26 ayat (2) UUPA, sehingga perjanjian nominee menajdi tidak sah dan tidak memiliki kekuatan hukum yang mengikat para pihak. / In Indonesia, the embodiment related to the regulation of the relationship between humans and land is contained in Article 33 paragraph (3) of the 1945 Constitution of the Republic of Indonesia as the basis for the issuance of Law Number 5 of 1960 concerning Basic Agrarian Regulations ("UUPA" ). Although it is expressly explained that foreign nationals cannot control the ownership of land rights with ownership rights in Indonesia, in practice there are several foreign nationals who can defeat the system of laws and regulations in Indonesia by making a nominee agreement or can also be referred to as an agreement. name borrowing with the object in the agreement is Property Rights.This research is a normative juridical type, namely research that emphasizes the use of secondary data by studying and studying positive legal norms or rules related to the subject matter to be discussed in the study. Ownership of land and buildings that can be owned by foreign nationals while in Indonesia is limited to usage rights, rental rights, ownership rights to flats and residential or residential houses. Foreign nationals in Indonesia are not allowed to own land rights with the status of property rights, building use rights and business use rights. Regarding nominee agreements made by foreign citizens and Indonesian citizens for buying and selling that do not fulfill one of the legal requirements of the agreement, namely a legal cause, which is indirectly prohibited in Article 26 paragraph (2) of the UUPA, so that the nominee agreement becomes invalid and does not have the force of law binding the parties.
