Abstract

Pasal 58 UUJN merupakan salah satu pasal yang menjadi kewajiban dari seorang Notaris yang menyebutkan bahwa Notaris diwajibkan untuk membuat daftar akta, daftar surat dibawah tangan yang disahkan, dan daftar surat dibawah tangan yang dibukukan untuk setiap harinya. Adapun pada faktanya, adalah adanya minuta akta yang tidak dicatatkan kedalam buku daftar akta (repertorium) oleh Notaris, jika Notaris melakukan kelalaian tersebut, maka resikonya akan besar dan hilang sifat dari keotentikan akta tersebut. Tujuan dari penelitian ini untuk menemukan akibat hukum dari kelalaian Notaris yang tidak mencatatkan akta dalam buku daftar akta (repertorium) serta menemukan dan memecahkan akibat hukum terhadap pihak ketiga jika akta Notaris tidak dicatatkan dalam buku daftar akta (repertorium). Metode yang digunakan dalam penelitian ini yaitu metode yuridis normatif sebagai upaya untuk mendapatkan data-data penelitian berupa data sekunder dengan menggunakan pendekatan terhadap kasus hukum, konseptual, dan perundang-undangan, yang mana setelah data-data penelitian tersebut dikumpulkan kemudian dianalisis dengan analisis induktif. Dari hasil penelitian dapat diperoleh bahwa akibat hukum kelalaian Notaris yang tidak mencatatkan akta dalam buku daftar akta (repertorium), dikenakan sanksi sesuai dengan ketentuan Pasal 58 UUJN, berupa peringatan tertulis, pemberhentian sementara, pemberhentian dengan hormat dan pemberhentian dengan tidak hormat. Akibat hukum terhadap pihak ketiga jika terdapat akta Notaris yang tidak dicatatkan dalam buku daftar akta (repertorium) adalah jelas merugikan para pihak yang tercatat dalam akta tersebut, apalagi jika akta yang dibuat dijadikan sebuah bukti di pengadilan. / Article 58 UUJN is one of the articles that is the obligation of a notary which states that a notary is required to make a list of deeds, a list of legalized private letters, and a list of privately made documents which are recorded for each day. As for the fact, there are minutes of deeds that are not recorded in the deed register book (repertorium) by the Notary, if the Notary commits this negligence, then the risk will be great and the nature of the authenticity of the deed will be lost. The purpose of this research is to find out the legal consequences of a notary's negligence in not recording the deed in the deed register (repertorium) and to find and solve the legal consequences for third parties if the notary's deed is not recorded in the deed register (repertorium). The method used in this study is the normative juridical method as an effort to obtain research data in the form of secondary data by using an approach to legal cases, conceptual and legislation, which after the research data is collected then analyzed by inductive analysis. From the results of the research it can be obtained that the legal consequences of negligence by a Notary who does not record the deed in the register of deeds (repertorium), are subject to sanctions in accordance with the provisions of Article 58 UUJN, in the form of written warnings, temporary dismissals, honorable discharges and dishonorable discharges. The legal consequences for third parties if there is a Notary deed that is not recorded in the register of deeds (repertorium) is clearly detrimental to the parties recorded in the deed, especially if the deed made is used as evidence in court.
