Abstract

Minyak dan gas bumi merupakan salah satu aspek penting bagi bangsa Indonesia dimana minyak dan gas bumi ini mencakup aspek kehidupan orang banyak. Pengeboran minyak dan gas bumi dapat dilakukan di daratan maupun di lepas pantai dilakukan dengan menggunakan alat pengeboran. Alat pengeboran di darat berupa onshore rig sedangkan alat pengeboran di lepas pantai berupa offshore rig. Penulisan ini mengkaji alat pengeboran lepas pantai yaitu Offshore Rig. Offshore Rig merupakan suatu peralatan pengeboran lepas pantai yang mempunyai nilai sehingga sangat memungkinkan untuk dijadikan sebagai jaminan dalam perolehan fasilitas ataupun kredit. Penulisan ini mengambil rumusan masalah mengenai kedudukan Offshore Rig sebagai benda menurut peraturan perundang-undangan yang berlaku di Indonesia serta hukum jaminan yang berlaku di Indonesia terhadap Offshore Rig. Jenis penelitian ini adalah penelitian hukum normatif dengan data sekunder yang diperoleh melalui studi kepustakaan dan didukung dengan wawancara. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan bahan-bahan hukum dan pendekatan terhadap asas-asas hukum serta data dianalisis dengan analisis kualitatif. Hasil penelitian ini menunjukan bahwa Offshore Rig mempunyai nilai dan Offshore Rig dapat didaftarkan kepemilikannya dengan berdasarkan hukum Indonesia. Dengan dapat didaftarkan kepemilikannya berdasarkan hukum Indonesia, maka Offshore Rig dapat juga dijaminkan berdasarkan ketentuan perundang-undangan yang berlaku. Penelitian ini mengkaji juga tata cara pendaftaran Offshore Rig serta jaminan yang berlaku terhadap Offshore Rig. / Oil and gas are one of the important aspects for the Indonesia whereas oil and gas cover many aspect of human’s live. The drilling of oil and gas can be done by onshore or offshore method by using drilling tools. Onshore drilling equipment is onshore rig while offshore drilling equipment is offshore rig. This writing examines offshore drilling equipment, namely Offshore Rig. Offshore Rig is an offshore drilling equipment that has value so that it is very possible to be used as collateral in obtaining facilities or credits. This writing takes the formulation of the problem regarding the position of the Offshore Rig as an property according to the laws and regulations in Indonesia and the security law applicable to offshore rig in Indonesia. This research is normative legal research with secondary data obtained through library research and supported by interviews. The approach used in this research is an approach to legal materials and an approach to legal principles and the data is analyzed by qualitative analysis. The results of this writing indicates that Offshore Rig has value and ownership of Offshore Rig can be registered under Indonesian law. As being able to register ownership under Indonesian law, Offshore Rig can also be guaranteed based on the provisions of the applicable laws and regulations. This study also examines the procedures for registering Offshore Rig and guarantees that apply to Offshore Rig.
