Abstract

Dari sisi golongan kebendaan, pesawat udara termasuk benda yang unik, karena meskipun masuk kedalam golongan benda bergerak, pesawat udara memiliki kewajiban untuk memiliki tanda pendaftaran dan juga tanda kebangsaan. Dari sisi hukum jaminan, pesawat udara merupakan objek jaminan yang mulai digemari didalam dunia perbankan internasional. Fakta yang sangat jauh berbeda terjadi di Indonesia dimana minim sekali pihak kreditur mau menerima jaminan berupa pesawat udara. Hal ini disebabkan oleh kekosongan hukum dalam peraturan perundang-undangan di Indonesia dalam menentukan lembaga jaminan apa yang berwenang untuk mengikat pesawat udara. Sehingga masih banyak ditemukan ketidakpastian yang membuat pihak Kreditur merasa tidak aman dan terjamin hak- haknya apabila pihak Debitur cidera janji/wanprestasi. Pemerintah Indonesia telah berusaha untuk mengatasi hal ini dengan meratifikasi ketentuan dalam Convention on International InterestsiIn Mobile Equipment beserta Protocol to The Convention on International Interests in Mobile Equipment on Matters Specific to Aircraft Equipment melalui Perpres No. 8/2007, sehingga UU No. 1/2009 tentang Penerbangan memberlakukan ketentuan-ketentuan dalam konvensi tersebut. Beberapa konsep dan instrument hukum menarik yang berhasil di adopsi oleh Indonesia melalui ratifikasi tersebut dapat ditemukan didalam UU No. 1/2009 yakni tentang Kepentingan Internasional dan juga Irrevocable Deregistration and Export Request Authorization. Namun, hal ini tetap saja tidak mengubah kondisi dimana sampai dengan ditulisnya Tesis ini, Indonesia masih belum menentukan lembaga jaminan apa yang berwenang untuk mengikat pesawat udara sebagai objek jaminan. Sehingga, pun menggunakan konsep dan instrumen hukum yang telah disebutkan diatas, risiko yang tinggi tetap mengikuti pihak Kreditur. Dalam penelitian ini, pengumpulan data dilakukan dengan menggunakan pendekatan perundang-undangan dan juga pendekatan konseptual. Dari hasil penelitian tersebut, dapat disimpulkan bahwa Indonesia belum memberikan kepastian hukum tentang lembaga apa yang berwenang untuk mengikat pesawat udara, sehingga di Indonesia para pihak sering mengatasinya dengan menggunakan lembaga jaminan Fidusia dan/atau Hipotik dengan memandang sebelah mata risiko- risiko yang mungkin timbul kedepannya / Seen from the type of goods, aircrafts are constituted as unique objects, because indeed they are categorized as movable goods, but unlike other movable goods, aircraft must obtain registration marks and nationality marks. In terms of being security objects, aircraft have attracted Creditors and become popular in the world of international banking. A very different fact occurs in Indonesia, where the numbers of attracted creditors are very little. This is due to the uncertainty in Indonesian legislation in determining which guarantee institutions are authorized to secure aircraft. Resulting in further uncertainties making the Creditors feel insecure about their rights if the Debtors in default. The Indonesian government has tried to overcome this by ratifying the provisions in the Convention on International Interest in Mobile Equipment along with the Protocol to the Convention on International Interest in Mobile Equipment on Matters Specific to Aircraft Equipment through Presidential Regulation No. 8/2007/. Thus, Law No. 1/2009 on Aviation adopt the provisions of the convention. There are several interesting concepts and legal instruments that have been successfully adopted by Indonesia through such ratification and can be found in Law No. 1/2009, namely: International Interest and Irrevocable Deregistration and Export Request Authorization. However, this still does not change the uncertainty condition on which guarantee institution is authorized to secure aircraft as a security object. By using the concept and legal instruments abovementioned, high risks will still follow the Creditors. In this Thesis, the data collection was carried out using a statutory approach and also a conceptual approach. From the results of these studies, it can be concluded that Indonesia has not provided legal certainty on which guarantee institutions are authorized to secure aircraft, so in Indonesia, the parties often resolve this issue by using Fiducia and /or Hypotheek and overlooked at the risks that might arise in the future
