Abstract

Ruang bawah tanah pada umumnya digunakan sebagai penunjang bangunan yang berada di bawah permukaan tanah. Dalam hal ini menjadi perhatian adalah sejauh mana ruang bawah tanah tersebut dapat dimanfaatkan oleh subyek hukum yang dikaitkan dengan asas hak menguasai negara atas ruang bawah tanah, sehingga perlu dilakukan pengkajian lebih mendalam terkait dengan hal tersebut. Masalah yang akan diangkat dalam penelitian berkaitan dengan tujuan yang ingin dicapai, yaitu untuk mengkaji serta menganalisis pelaksanaan perwujudan asas hak menguasai negara atas tanah dalam hukum agraria dan mengkaji serta menganalisis berkaitan dengan kepastian hukum Hak Menguasai Negara terhadap ruang di bawah tanah sejak berlakunya Peraturan Pemerintah Nomor 18 Tahun 2021 Tentang Hak Pengelolaan, Hak Atas Tanah, Satuan Rumah Susun dan Pendaftaran Tanah. Metode penelitian yang digunakan bersifat yuridis normatif melalui pendekatan peraturan perundang-undangan. Data yang digunakan bersumber dari bahan hukum primer, sekunder, dan tersier dengan pengumpulan data dilakukan dengan teknik kepustakaan yang kemudian dianalisis secara kualitatif. Pelaksanaan perwujudan asas hak menguasai negara bukan merupakan sebagai pemilik, tetapi penguasaan atas tanah sebagai perwujudan Pasal 33 ayat (3) UUD 1945 dan Pasal 2 ayat (1), (2), dan (3) UUPA. Asas hak menguasai negara berbeda pengertian dengan asas ‘domein verklaring’, bila ditinjau berdasarkan ketentuan Pasal 74 ayat (1) PP No.18/2021, maka subjek hukum dapat memanfaatkan ruang bawah tanah sampai dengan kedalaman 30 meter, sedangkan lebih dari 30 meter merupakan hak menguasai negara. Dalam hal terdapat pemanfaatan sumber daya minyak dan gas bumi serta mineral dan batu bara, hak atas tanah pada ruang bawah tanah tidak dapat diberikan. PP No.18/2021 memberikan penguatan sekaligus kepastian hukum hak menguasai negara, dimana penguasa negara dapat mengontrol dan mengendalikan fungsi pemanfaatan tanah sehingga dapat lebih mengedepankan prinsip kepentingan umum, ekonomi, pembangunan, dan sosial. / The basement is generally used as a support for buildings that are below ground level. In this case, the concern is to what extent the basement can be used by legal subjects associated with the principle of the state's right to control over underground space, so that a more in-depth study is needed in this regard. The issues to be raised in this research are related to the objectives to be achieved, namely to study and analyze the implementation of the principle of state control over land in agrarian law and study and analyze related to the legal certainty of the State's Controlling Rights over underground space since the enactment of Government Regulation Number 18 of 2021 on Right To Manage, Land Right, Apartement Unit and Land Registration. The research method used is normative juridical through the approach of statutory regulations. The data used comes from primary, secondary, and tertiary legal materials with data collection carried out using library techniques which are then analyzed qualitatively. The implementation of the principle of the state's right to control is not as an owner, but control over land as a manifestation of Article 33 paragraph (3) of the 1945 Constitution and Article 2 paragraph (1), (2), and (3) of the UUPA. The principle of the right to control the state has a different understanding from the principle of 'domein verklaring', when viewed based on the provisions of Article 74 paragraph (1) PP No.18/2021, legal subjects can utilize basements up to 30 meters deep, while more than 30 meters is state control rights. In the event that there is exploitation of oil and natural gas as well as mineral and coal resources, land rights in the basement cannot be granted. PP No.18/2021 provides both strengthening and legal certainty of the state's right to control, whereby state authorities can control and control the function of land use so that they can prioritize the principles of public, economic, development and social interests.
