Abstract

International investment agreement is one of the instruments in the protection of foreign investors and their investments in the host country. The main element of this agreement is protection, in addition to other elements such as promotion and liberalization. Of all the protection substances, there is one most controversial provision, namely the provision of fair and equitable treatment. This provision require the host country to provide fair and equitable to foreign investor and their investment. However, it is not clear enough on what is “fair” and “equitable”, nor is it clear enough what standard is used in determining unfair or unequitable conduct. This research was conducted to find out what is the scope fair and equitable, and the standard is used in the context. The study also analyzed the impact of the commitment to fair and equitable treatment for the Government of Indonesia. In the end, this study will discuss the most ideal formula in providing a fair and equitable treatment in investment agreement. / Perjanjian investasi internasional merupakan salah satu instrumen dalam melindungi investor asing dan investasinya di negara tuan rumah. Elemen utama dari perjanjian ini adalah proteksi, disamping elemen lainnya seperti promosi dan liberalisasi. Dari seluruh substansi proteksi, terdapat satu provisi yang paling kontroversial, yaitu provisi fair and equitable treatment. Provisi ini mengatur komitmen negara tuan rumah untuk memberikan perlakuan yang fair dan equitable kepada pemerintah. Namun demikian, tidak cukup jelas apa yang dimaksud dengan fair dan equitable, dan tidak juga cukup jelas standar apa yang digunakan dalam menilai suatu tindak unfair atau inequitable. Penelitian ini meneliti mengenai ruang lingkup tindakan pemerintah yang dianggap melanggar komitmen fair and equitable, dan standar apa yang digunakan dalam menilainya. Penelitian ini juga menganalisis dampak dari komitmen fair and equitable treatment bagi Pemerintah Indonesia. Pada akhirnya, penelitian ini akan menyimpulkan mengenai bagaimana formula yang paling ideal dalam memberikan komitmen fair and equitable treatment.
