Abstract

Indonesia is a developing country that has become a member of the WTO since 1995 and is active in international trade with countries other WTO members. In support of international trade it is necessary develop the capacity of all business operators in Indonesia. Export plays a very important role for Indonesia in the global market. In practice, Indonesian exporters often get accusations of dumping from the importing country. To overcome this problem, there is an urgency for Indonesia to form an effective and adequate policy, as an effort in protect Indonesian exporters. The policy is preventive (preventive) so that Indonesian exporters can avoid exporting products conducted by dumping. To support the policy, it is needed the establishment of regulations to provide a basis for legal certainty and guarantee of protection for Indonesian exporters. The regulation will regulates access to information related to exports and also the formation of committees specifically in its implementation. With the regulations that supported work the same between the Government and domestic businesses, in particular exporters are expected to provide added value not only beneficial for exporters, but also for other business stakeholders. / Indonesia adalah negara berkembang yang telah menjadi anggota WTO sejak tahun 1995 dan aktif dalam perdagangan internasional dengan negara-negara anggota WTO lainnya. Dalam mendukung perdagangan internasional perlu mengembangkan kapasitas seluruh pelaku usaha di Indonesia. Ekspor memainkan peranan yang sangat penting bagi Indonesia di pasar global. Dalam praktiknya, eksportir Indonesia kerap memperoleh tuduhan dumping dari negara pengimpor. Untuk mengatasi permasalahan ini, terlihat urgensi bagi Indonesia untuk membentuk suatu kebijakan yang efektif dan memadai, sebagai upaya dalam melindungi eksportir Indonesia. Kebijakan tersebut bersifat pencegahan (preventive) agar eksportir Indonesia dapat menghindarkan diri dari ekspor produk yang dilakukan secara dumping. Untuk mendukung kebijakan tersebut, diperlukan pembentukan peraturan guna memberikan landasan bagi kepastian hukum dan jaminan perlindungan terhadap eksportir Indonesia. Peraturan tersebut akan mengatur pemberian akses informasi terkait ekspor dan juga pembentukan komite khusus dalam implementasinya. Dengan adanya peraturan yang ditunjang kerja sama yang baik antara Pemerintah dan pelaku usaha di dalam negeri, khususnya para eksportir, diharapkan dapat memberikan nilai tambah yang tidak hanya bermanfaat bagi eksportir, namun juga bagi para pemangku usaha lainnya.
