Abstract

Majelis Pengawas Notaris sebagai badan yang mempunyai kewenangan dan kewajiban untuk melaksanakan pembinaan dan pengawasan terhadap Notaris. Dengan adanya pernyataan dari Menkumham terkait banyaknya laporan dari masyarakat karena pelanggaran Notaris yang tidak bersikap profesional dalam menjalankan jabatannya. Oleh karena itu Penelitian ini berfokus pada pembinaan dan pengawasan Notaris oleh Majelis Pengawas Daerah Kota Tangerang. Memiliki tujuan berupaya untuk pencegahan terjadinya pelanggaran oleh Notaris khususnya di Kota Tangerang yang dijadikan Kota sebagai tempat penelitian, agar Notaris dapat menjalankan jabatannya sesuai ketentuan Undang-Undang Jabatan Notaris dan Undang-Undang yang terkait. Metode yang digunakan adalah pendekatan hukum Yuridis Normatif dibantu dengan Wawancara dengan pihak Majelis Pengawas Daerah Kota Tangerang, dan salah satu Notaris yang terkait dengan penelitian ini. Hasil kajian penelitian menunjukkan bahwa Majelis Pengawas Daerah Kota Tangerang melakukan pembinaan dan pengawasan sesuai aturan Undang-Undang Jabatan Notaris. Adapun pembinaan yang dimaksud, ialah pembinaan dalam tugas pelaksanaan Notaris, Kode Etik, dan prilaku Notaris di luar jabatan Notaris. faktor penyebab Notaris melakukan pelanggaran saat menjalankan jabatannya diantaranya kurangnya kejujuran dan kedisiplinan Notaris dalam menjalankan jabatannya, kurang pahamnya Notaris terhadap peraturan dan Kode Etik Notaris. Untuk meminimalisir faktor-faktor diatas perlu adanya pendampingan oleh Majelis Pengawas Daerah Kota Tangerang terhadap Notaris dalam menjalankan jabatannya. / Notary Supervisory Board as a body that has the authority and obligation to carry out guidance and supervision of Notaries. With the statement from Menkumham regarding the number of reports from the publik due to violations by Notaries who did not behave professionally in carrying out their positions. Therefore this research focuses on the guidance and supervision of Notaries by the Regional Supervisory Board of the City of Tangerang. Has the aim of trying to prevent violations by Notaris, especially in the City of Tangerang which is used as a City for research, so that Notaries can carry out their positions in accordance with the provisions of the Law on Notary Position and related Laws. The method used is a Normative Juridical legal approach assisted by Interviews with the Regional Supervisory Board of the City of Tangerang, and one of the Notaries associated with this research. The results of the research study show that the Regional Supervisory Board of the City of Tangerang carries out guidance and supervision in accordance with the Notary Office Law. The coaching in question is coaching in the duties of implementing a Notary, the Code of Ethics and the behavior of a Notary outside the position of a Notary. Factors that cause a Notary to commit an offense while carrying out his/her position include a lack of honesty and discipline in the Notary in carrying out his/her position, the Notary’s lack of understanding of the rules and the Notary’s Code of Ethics. To minimize the above factors, it is necessary to have assistance from the Tangerang City Regional Supervisory Board for Notaries in carrying out their positions.
