Abstract
In today’s business, many shoe design are available in the market and are being sold to the consumer. Some of these shoe designs are the result of a shoe designer thoughts when creating and making the design for the shoe itself. Unfortunately, some irresponsible sellers are selling their shoe based on someone else shoe design. In the case of Hadiyanto Tjukup Wirawan as The Defendant v Theng Tjhing Djie as The Plaintiff, The Plaintiff suspect that The Defendant is selling his shoe by making a forgery or imitation from The Plaintiff own shoe design. The Plaintiff brought the case to Commercial Court and have the Judge approval from his reasoning. The Defendant not agreeing with the Commercial Court result then brought the case back to the Supreme Court and have his reasoning and explanation as to why The Defendant shoe design is original and not a forgery or imitation from The Plaintiff shoe design.
