Abstract

Merek adalah salah satu Kekayaan Intelektual yang terdiri dari tanda, desain, atau simbol yang dapat dikenali untuk membedakan barang atau jasa yang satu dengan barang atau jasa yang lain. Merek dagang suatu barang terdapat pada kemasan barang itu sendiri. Untuk mendapatkan perlindungan hukum dan hak merek, merek harus didaftarkan ke Direktorat Jenderal Hak Kekayaan Intelektual. Sistem pendaftaran merek di Indonesia adalah sistem pendaftaran first to file artinya pendaftar pertama berhak atas merek tersebut. Syarat utama dari pendaftaran merek adalah itikad baik pendaftar. Merek yang didaftarkan dengan itikad tidak baik adalah merek yang mempunyai persamaan pada pokoknya atau secara keseluruhan dengan merek lain yang sudah didaftarkan terlebih dahulu atau merek terkenal. Sengketa merek terkenal Avitex milik PT Avia Avian bermula ketika Iwan mendaftarkan merek Envitex yang diproduksi oleh PT Indaco Coating Industry dengan itikad tidak baik dan berusaha untuk menjiplak merek terkenal Avitex yang telah didaftarkan terlebih dahulu. PT Avia Avian memenangkan sidang sengketa merek di Pengadilan Niaga, Iwan mengajukan Kasasi namun ditolak, dengan demikian merek Envitex dibatalkan. = Trademark is one of Intellectual Property consisting of a recognizable sign, design, or expression that identifies products or services from a particular source and distinguishes them from others. A trademark may be located on a package, a label, or on the product itself. To get trademark legal protection and rights, trademark must be registered to Directorate General of Intellectual Property Trademark Sub-Directorate of Trademark. The trademark registration system adopted in Indonesia is first to file registration system meaning that the first registrant has the rights to the trademark. The most important indicator of marking registration of a brand is the the good intention of the registrant. A trademark registered in bad faith is a trademark that has similarities in principle or in whole with other registered trademarks or with well known/famous mark. The brand dispute over the well-known Avitex brand belongs to PT Avia Avian started when Iwan registered the Envitex brand which was produced by PT Indaco Coating Industry in bad faith and attempted to pass off the well-known Avitex brand which had been registered beforehand. PT Avia Avian won the trademark dispute trial in the court, Iwan filed an appeal but was rejected, resulting in the cancellation of the Envitex brand.
