Abstract

Tujuan dari penelitian ini adalah untuk memahami alasan mengapa sulit dijalankannya prosedur eksekusi atas putusan PHI yang inkracht dan untuk lebih memahami adakah perlindungan hukum dan kepastian hukum bagi hak – hak tenaga kerja dengan adanya putusan inkracht dari Pengadilan Hubungan Industrial. Jenis penelitian ini menggunakan penelitian hukum yuridis normatif yaitu mengkaji keabsahan alasan-alasan sulit dijalankannya proses eksekusi dan perlindungan hukum bagi tenaga kerja dari putusan inkracht Pengadilan Hubungan Industrial. Bahan hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder, bersumber dari peraturan perundang-undangan, putusan PHI, MK dan MA serta teori atau pendapat para ahli. Metode pengumpulan data melalui studi kepustakaan dan internet. Pendekatan penelitian undang-undang (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian, kesulitan yang timbul dalam menjalankan proses eksekusi atas putusan PHI yang inkracht adalah ketiadaan peraturan yang mengatur mengenai upaya eksekusi lanjutan terhadap putusan PHI dalam Undang-Undang No. 2 Tahun 2004 tentang Penyelesaian Perslisihan Hubungan Industrial. Ketiadaan sanksi membuat perusahaan sengaja menunda atau menghindari menjalankan amar putusan dari Pengadilan Hubungan Industrial. Peraturan mengenai eksekusi harus berdasarkan Kitab Undang - Undang Hukum Acara Perdata. KUHPer menjadi dasar bagi tenaga kerja untuk memperoleh perlindungan hukum dan kepastian hukum bagi hak - haknya. / The purpose of this research is to understand the reasons why it is hard to carry out the execution procedure of the Industrial Relation Court’s verdict and to have a better understanding whether there is a legal protection and legal certainty for labor rights, after the Industrial Relation Court’s permanent legal force. This research uses normative juridical legal research, which examines the validity of the reasons for the difficulty in carrying out the execution procedure and the legal protection and legal certainty for labor rights, after the Industrial Relation Court’s verdict. The material used are primary and secondary legal material, sourced from the legislation, the decisions of the Constitutional Court, and the Supreme Court as well as theories or expert’s opinion. Method of data collection through literature studies and internet studies. Research approach using statute approach and conceptual approach. The result of this research, the absence of legal regulations in the Labor Law regarding further execution effort is the reason of the difficulty in carrying out the execution procedure. This makes company deliberately delays or avoids carrying out the verdict of the Industrial Relations Court. The Civil Code is now used as the basis of legal regulations regarding execution. Labors use the Civil Code as the basis to get legal protection and legal certainty for their rights.
