Abstract

Permasalahan tindak pidana korupsi Indonesia merupakan hal yang cukup merajalela di Indonesia. Mengingat tindak pidana korupsi ini dapat merugikan keuangan negara dan juga merupakan pelanggaran hak – hak sosial dan ekonomi masyarakat, menghambat pertumbuhan dan kelangsungan pembangunan nasional untuk mewujudukan masyarkat adil dan makmur. Tindak pidana korupsi ini sendiri bukan merupakan kejahatan biasa melainkan kejahatan luar biasa atau bisa disebut extraordinary crimes. Pada umumnya, mengingat tindak pidana korupsi dilakukan berencana maka pembuktian nya cukup sulit dilakukan. Didasarkan oleh sulitnya pembuktian dalam tindak pidana korupsi, maka dikenal dengan adanya asas pembuktian terbalik yang dimana terdakwa mempunyai hak untuk melakukan pembuktian di muka pengadilan, namun dalam hal ini, jaksa tetap berkewajiban untuk melakukan pembuktian atas dakwaannya. Sebagaimana tercantum dalam Undang – Undang No. 31 Tahun 1999 Jo Undang – Undang No. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Penulisan ini menggunakan tipe penelitian yuridis normatif, yaitu dilakukan melalui studi Pustaka dan pendekatan secara statue approach dan conceptual approach./ The problem of corruption in Indonesia is quite rampant in Indonesia. Remembering that this criminal act of corruption can be detrimental to state finances and is also a violation of social and economic rights of the community, hindering the growth and continuity of national development to create a just and prosperous society. This criminal act of corruption itself is not an ordinary crime but it can be called as an extraordinary crimes. However, in general, the act and doing of corruption is being planned out, thus making it is quite difficult to prove it. Based on the difficulty of proving a criminal act of corruption, the existence of the principle of reverse proof where the defendant has the right to prove in the court are being known. However, in this case, the prosecutor is still obliged to prove his indictment. As stated in Undang – Undang No. 31 Tahun 1999 Jo Undang – Undang No. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. This research uses a normative juridical method using literature study and approach using statue approach and conceptual approach.
