Abstract

Tujuan penelitian ini adalah untuk mengetahui keabsahan suatu perjanjian Polis Asuransi Jiwa PT Prudential Life Assurance dan untuk mengetahui implementasi klaim dalam perjanjian Polis Asuransi Jiwa PT Prudential Life Assurance serta untuk mengetahui cara penyelesaian masalah apabila terjadi perselisihan antara kedua belah pihak demi mengutamakan keadilan yang bermartabat sesuai dengan Undang - Undang Dasar 1945. Metode penelitian adalah kualitatif yang bersifat deskriptif berdasarkan hukum normatif yuridis menggunakan buku Polis Asuransi PT Prudential Life Assurance sebagai data sekunder berupa bahan bahan primer, bahan sekunder serta tersier guna menganalisis secara detail hanya sebatas menggambarkan apa adanya yang tertera dengan isi kontrak Polis Penanggung yang menjadi kesepakatan para pihak lalu membedahnya dengan menggunakan peraturan perundang - undangan terkait perasuransian, buku serta website maupun jurnal menurut studi kepustakaan. Hasil penelitian yang diperoleh penulis adalah Keabsahan suatu perjanjian Polis Asuransi Jiwa adalah sebagaimana tertulis dalam poin 2 (dua) ketentuan umum buku Polis Asuransi Jiwa PT Prudential Life Assurance terkait Dasar Pertanggungan yaitu Nasabah wajib menyampaikan kepada Perusahaan Asuransi Jiwa mulai dari berupa surat pengajuan asuransi jiwa (SPAJ), formulir - formulir dan dokumen - dokumen lain yang diisyaratkan secara benar dan lengkap. Kebenaran dan kelengkapan surat pengajuan asuransi jiwa (SPAJ), formulir - formulir dan dokumen - dokumen tersebut di atas menjadi tanggung jawab Nasabah. Implementasi klaim dalam perjanjian Polis Asuransi Jiwa sudah diatur sebagaimana tertulis dalam Poin 3 (tiga) ketentuan umum buku polis Perusahaan Asuransi Jiwa PT Prudential Life Assurance terkait Berlakunya Pertanggungan di katakan bahwa : suatu pertanggungan berdasarkan polis mulai berlaku sejak tanggal mulai pertanggungan yang tertera pada ringkasan polis dengan ketentuan bahwa premi yang pertama telah dilunasi. Cara penyelesaian masalah apabila terjadi perselisihan antara kedua belah pihak adalah sebagaimana sudah tertulis dalam ketentuan umum buku Polis Asuransi Jiwa PT Prudential Life Assurance di poin 17 (tujuh belas) terkait Penyelesaian Sengketa yaitu mengutamakan penyelesaian permasalahan melalui jalur musyawarah terlebih dahulu, sebelum melalui jalur Pengadilan Negeri di dalam wilayah Republik Indonesia yang berwenang menurut ketentuan peraturan perundang - undangan yang berlaku. Permasalahan - permasalahan Asuransi Jiwa di Indonesia suatu keharusan menjadi tanggung jawab Negara dan kita bersama untuk mampu mengatasi setiap permasalahan yang terjadi./ The purpose of this study was to determine the validity of a PT Prudential Life Assurance Life Insurance Policy agreement and to find out the implementation of claims in the PT Prudential Life Assurance Life Insurance Policy agreement and to find out how to resolve problems in the event of a dispute between the two parties in order to prioritize dignified justice in accordance with The 1945 Constitution. The research method is qualitative descriptive based on normative juridical law using the PT Prudential Life Assurance Insurance Policy book as secondary data in the form of primary, secondary and tertiary materials to analyze in detail only to describe what is stated with the contents of the Insurer's Policy contract which is an agreement the parties then dissected it using laws and regulations related to insurance, books and websites and journals according to literature studies. The research results obtained by the author are that the validity of a life insurance policy agreement is as written in point 2 (two) general provisions of the PT Prudential Life Assurance Life Insurance Policy book regarding the Basis of Coverage, namely that the customer is required to submit to the Life Insurance Company starting from a life insurance application letter (SPAJ), other forms and documents required correctly and completely. The correctness and completeness of the life insurance application letter (SPAJ), the forms and documents mentioned above are the responsibility of the Customer. Implementation of claims in the Life Insurance Policy agreement has been regulated as written in Point 3 (three) general provisions of the policy book of the Life Insurance Company PT Prudential Life Assurance regarding the Applicability of Cover it says that: a coverage based on a policy starts from the start date of coverage stated in the policy summary provided that the first premium has been paid. The method of solving the problem in the event of a dispute between the two parties is as written in the general provisions of the PT Prudential Life Assurance Life Insurance Policy book in point 17 (seventeen) regarding Dispute Resolution, namely prioritizing problem resolution through deliberation before going through the District Court. within the territory of the Republic of Indonesia which is authorized according to the provisions of the applicable laws and regulations. The problems of life insurance in Indonesia are the responsibility of the state and all of us to be able to overcome any problems that occur.
