Abstract

This study aims to determine criminal responsibility for someone who carries out a forced defense that exceeds the limit (Noodweer Exes) in decision number 103/Pid.B/2021/PN.Gdt and also to find out the considerations of the Panel of Judges giving a defense decision that has exceeded the limit (Noodweer Exces) in decision number 103/Pid.B/2021/PN.Gdt. This study uses empirical normative research methods, namely a combination of normative legal approaches with the addition of various empirical. This study uses secondary data, namely data obtained indirectly/already available in the form of expert writing and research results. The method of obtaining data in this study was carried out by studying literature on books, journals and various theses from the internet. This study uses a type of approach to legal cases (case study). This study analyzes qualitative data by collecting data, compiling, separating and connecting to theories related to research problems to draw conclusions. The research results obtained are that criminal liability for someone who defends is forced to exceed the limit (noodweer excesses) in decision number 103/Pid.B/2021/PN.Gdt, the defendant is released from all lawsuits, because his actions can be used as an excuse for forgiveness by eliminating / negate the defendant's guilt, where there is a state of the defendant's soul that is shaken very badly. The basis and analysis considerations of the Panel Judges' consideration stated that the defendant fulfilled the conditions of forced defense that exceeded the limits (noodweer excesses) in Article 49 paragraph (2) of the Criminal Code, that the defense carried out by the Defendant was balanced with the attack carried out by the victim against the Defendant, the defense carried out by the Defendant was the interests of the body/body of the Defendant himself were suddenly attacked against the law, and the emergency defense was carried out by the Defendant who was in a state of extreme turmoil/feeling that made the Defendant's eyes dark./ Penelitian ini bertujuan untuk mengetahui pertanggungjawaban pidana terhadap seseorang yang melakukan pembelaan terpaksa yang melampaui batas (Noodweer Exces) dalam putusan nomor 103/Pid.B/2021/PN.Gdt dan juga untuk mengetahui pertimbangan Majelis Hakim memberi putusan pembelaan terpaksa yang melampaui batas (Noodweer Exces) dalam putusan nomor 103/Pid.B/2021/PN.Gdt. Penelitian ini menggunakan metode penelitian normatif empiris yaitu penggabungan antara pendekatan hukum normatif dengan penambahan berbagai empiris. Penelitian ini menggunakan data sekunder yaitu data yang diperoleh secara tidak langsung/telah tersedia dalam bentuk tulisan ahli dan hasil penelitian. Cara perolehan data dalam penelitian ini dilakukan dengan studi kepustakaan terhadap buku-buku, jurnal maupun berbagai skripsi dari internet. Penelitian ini menggunakan jenis pendekatan terhadap kasus hukum (case study). Penelitian ini menganalisis data kualitatif dengan cara mengumpulkan data, menyusun, memisahkan dan menghubungkan ke teori yang berkaitan dengan permasalahan penelitian untuk menarik kesimpulan. Hasil penelitian yang diperoleh adalah pertanggungjawaban pidana terhadap seseorang yang melakukan pembelaan terpaksa yang melampaui batas (noodweer exces) dalam putusan nomor 103/Pid.B/2021/PN.Gdt adalah terdakwa dilepaskan dari segala tuntutan hukum, karena perbuatannya dapat dijadikan sebagai alasan pemaaf dengan menghapuskan/meniadakan kesalahan terdakwa, dimana terdapat keadaan jiwa terdakwa yang terguncang sangat hebat. Dasar dan analisa pertimbangan Majelis Hakim menyatakan terdakwa memenuhi syarat-syarat pembelaan terpaksa yang melampaui batas (noodweer exces) dalam Pasal 49 ayat (2) KUHP, bahwa pembelaan yang dilakukan oleh Terdakwa adalah seimbang dengan serangan yang dilakukan oleh korban kepada Terdakwa, pembelaan yang dilakukan oleh Terdakwa merupakan kepentingan terhadap badan/tubuh Terdakwa sendiri yang diserang secara sekonyong-konyong melawan hukum, dan pembelaan darurat dilakukan oleh Terdakwa yang sedang dalam keadaan jiwa/perasaan yang terguncang sangat hebat yang membuat Terdakwa menjadi gelap mata.
