Abstract

Leasing is a purchase transaction that is not carried out in cash where the buyer has received the goods as an object of sale and purchase, but has not paid the price, either in whole or in part, and payments are made slowly according to the agreement made by the parties involved. Leasing as one of the financing systems that has a role in increasing national economic development. This is because leasing is an alternative financing that helps entrepreneurs in obtaining capital goods by way of rent or purchase and capital goods can also be directly used in conducting production activities, while leasing payments can be made periodically or in installments. This study has two objectives, namely to determine the role of legal analysis on the actions of the Debt Collector to take the motorbike withdrawal in the Leasing agreement. The parties to the leasing agreement include the lessor, supplier, and lessee. The laws of the parties related to the financing relationship using leasing in the context of marketing of motorized vehicles are: The lessor provides the cost of purchasing the motorcycle in cash to the supplier. The supplier gives the motor to the lessee. After the lessee acquires the motor, he makes rental payments to the lessor. The results of this study aim to explain motorized vehicles in the eyes of the law. And also, this research uses the method of collecting data from the existing internet. From the results of the research, it was explained that the leasing system at PT Adira Dinamika Multi Finance Tbk had violated existing laws because it was suspected of posing threats to victims. Where if in accordance with existing law, there should be no forced withdrawal. Asset confiscation should only be carried out by assigned state officials / Leasing adalah jual beli yang dilakukan tidak secara kontan dimana pembeli sudah menerima barang sebagai obyek jual beli, namun belum membayar harga, baik keseluruhan maupun sebagian dan pembayaran dilakukan secara perlahan sesuai dengan kesepakatan yang dilakukan oleh pihak yang terlibat. Leasing mempunyai peranan penting dalam pembangunan perekonomian karena sebagai salah satu alternatif pembiayaan yang membantu para pengusaha dalam memperoleh barang modal dengan cara sewa atau beli dan barang modal tersebut juga dapat langsung digunakan dalam melakukan kegiatan produksi, sedangkan pembayaran sewanya dapat dilakukan secara berkala atau secara angsuran. Penelitian ini memiliki dua tujuan yaitu untuk mengetahui peran analisis hukum terhadap tindakan Debt Collector melakukan tindakan penarikan sepeda motor dalam penyelesaian perjanjian Leasing. Para pihak dalam perjanjian leasing antara lain lessor, supplier, dan lessee. Hubungan hukum para pihak tersebut terkait dengan penyaluran pembiayaan dengan menggunakan leasing dalam rangka pemasaran kendaraan bermotor adalah: Lessor memberikan biaya pembelian motor secara tunai kepada supplier. Supplier memberikan kendaraan bermotor kepada lessee. Setelah lessee memperolehnya, maka ia melakukan pembayaran lease kepada lessor. Hasil dari Penelitian ini bertujuan untuk menjelaskan leasing kendaraan bermotor di mata hukum. Dan juga penelitian ini menggunakan metodr pengumpulan data dari internet yang ada. Dari hasil penelitian, dijelaskan bahwa sistem leasing pada PT Adira Dinamika Multi Finance Tbk telah melanggar hukum yang ada karena diduga telah memberikan ancaman kepada korban. Dimana jika sesuai dengan hukum yang ada, tidak boleh adanya dilakukan penarikan secara paksa. Penyitaan asset seharusnya hanya boleh dilakukan oleh para aparat negara yang ditugaskan
