Abstract

The Job Creation Law changed the legal provisions regarding wages. The purpose of this research is to describe the legal arrangements regarding workers' wages after the Job Creation Law and to describe the legal protection for workers for the certainty of payment of their wages after the Job Creation Law. This type of research is normative juridical research, namely research on wage provisions in the Labor Law after the Job Creation Law. The data used is secondary data in the form of primary legal materials, secondary legal materials, and tertiary legal materials. Data obtained through library and internet research. The research approach is the statutory regulation approach. Data analysis was carried out qualitatively. Result, the provisions regarding wages after the Job Creation Law contained deletions, changes and additions to articles in the Manpower Law. Elimination of unfair UMSP and UMSK for workers, elimination of delays in payment of minimum wages by employers is not fair for employers who have not been able to pay, removal of the deadline for demands for payment of fair wages for workers. Changes to several articles regarding the determination of wages based on decent income for humanity are changed to the structure and scale of wages, changes to wages based on worker competence are changed to be based on company capabilities and productivity, giving more authority to companies. Amendments to the article on fines, replaced with workers' wages take precedence if the entrepreneur is bankrupt or in liquidation providing legal certainty for the payment of wages and the rights of laid-off workers. Fine provisions are included in PP No. 36 of 2021 provides more flexibility for the government to make changes in the future. Changes regarding the Wage Council regulated by the Presidential Decree were changed to Government Regulations in accordance with the hierarchy of statutory regulations. The addition of the article further emphasizes the flexibility of determining wages based on agreement, but not below the UMP/UMK except for wages for Small and Micro Enterprises and wages based on time units and units of output. Protection for Workers for legal certainty of payment of wages after the Job Creation Law consists of preventive protection that is, the provisions on the payment of workers' wages are quite complete, because it is clear what rights and obligations are the legal guidelines for employers and workers, and repressive protection in the form of criminal sanctions, administrative sanctions and fines for violations of wage payment provisions according to Government Regulation No. 36 of 2021 / UU Cipta Kerja mengubah ketentuan hukum tentang pengupahan. Tujuan penelitian ini adalah untuk mengetahui pengaturan hukum tentang pengupahan pekerja setelah UU Cipta Kerja dan untuk mengambarkan perlindungan hukum bagi pekerja atas kepastian pembayaran upahnya setelah UU Cipta Kerja. Jenis penelitian ini adalah penelitian yuridis normatif yaitu penelitian terhadap ketentuan pengupahan dalam UU Ketenagakerjaan setelah UU Cipta Kerja. Data yang digunakan adalah data sekunder berupa bahan hukum primer, bahan hukum sekunder, bahan hukum tersier. Data diperoleh melalui penelitian kepustakaan dan internet. Pendekatan penelitian adalah pendekatan peraturan perundang-undangan. Analisis data dilakukan secara kualitatif.Hasil penelitian, ketentuan tentang pengupahan setelah UU Cipta Kerja terdapat penghapusan, perubahan dan penambahan pasal pada UU Ketenagakerjaan. Penghapusan UMSP dan UMSK tidak berkeadilan bagi pekerja, penghapusan penangguhan pembayaran upah minimum oleh pengusaha tidak berkeadilan bagi pengusaha yang belum mampu membayar, penghapusan batas kadaluarsa tuntutan pembayaran upah adil bagi pekerja. Perubahan beberapa pasal mengenai penetapan upah didasarkan penghasilan layak bagi kemanusiaan diubah ke struktur dan skala upah, perubahan upah berdasarkan kompetensi pekerja diubah menjadi berdasarkan kemampuan perusahaan dan produktivitasnya, lebih memberikan kewenangan kepada perusahaan. Perubahan pasal tentang denda, diganti dengan upah pekerja didahulukan bila pengusaha pailit atau dalam likuidasimemberikan kepastian hukum pembayaran upah dan hak pekerja yang di PHK. Ketentuan denda dicantumkan dalam PP No. 36 Tahun 2021 lebih memberikan keleluasaan bagi pemerintah untuk melakukan perubahan di kemudian hari. Perubahan mengenai Dewan Pengupahan diatur Keppres diganti ke Peraturan Pemerintah telah sesuai dengan hierarkhi peraturan perundang-undangan.Penambahan pasal, lebih mempertegas fleksibilitas penetapan upah atas kesepakatan, tetapi tidak di bawah UMP/UMK kecuali upah pada Usaha Kecil dan Mikro dan upah didasarkan satuan waktu dan satuan hasil, Perlindungan bagi Pekerja atas kepastian hukum pembayaran upah setelah UU Cipta Kerja terdiri dari perlindungan preventif yaitu ketentuan pembayaran upah pekerja sudah cukup lengkap, sebab jelas apa hak dan kewajiban yang menjadi pedoman hukum bagi pengusaha dengan pekerja, dan perlindungan represif berupa sanksi pidana, sanksi administratif dan denda atas pelanggaran ketentuanpembayaran upah sesuai PP No. 36 Tahun 2021.
