Abstract

The purpose of this research is to find out the accountability of banking institutions and the government in the aspect of legal protection for customers for losses suffered as a result of using mobile banking services and to find out how legal settlement efforts are made due to losses due to acts of embezzlement of customer funds through mobile banking services. The research method used by the authors in this study is a normative empirical research method, connected with the analysis of normative legal implementation provisions (legislation) and associated with the support of field data obtained from the results of interviews with informants related to research problems. The research data was collected by field research and library research, namely conducting research by means of study in the library through reading references in the form of books, articles, and legal journals as well as through the results of interviews which were then used as material to produce conclusions that answer the research problem. While the data analysis used is qualitative data analysis, namely collecting, analyzing, and interpreting primary and secondary data which are arranged in a systematic, clear, and detailed manner which are then analyzed with the logic of legal thinking. The result of the research, shows that the accountability of banks and government agencies for losses suffered by customers, in this case ideally will be associated with proving losses originating from errors and losses on the part of customers or the bank. As for legal remedies that can be taken by customers in carrying out legal settlements due to losses arising from the use of this mobile banking service, namely through litigation (dispute) and non-litigation. However, in order to create legal certainty, it is necessary to enact laws that regulate specifically, structured and comprehensively regarding customer protection, harmonize existing laws and regulations and maximize clear mechanisms related to coordination between legal actors to create legal certainty. Seeing the results of this study shows there are still no laws and regulations that specifically regulate the usage of mobile banking services, but Indonesia’s positive laws perspective contain laws and regulations that can be adjusted as legal protection toward customers who use the mobile banking services. / Tujuan dilakukannya penelitian ini adalah untuk mengetahui pertanggungjawaban lembaga perbankan dan pemerintah dalam aspek perlindungan hukum bagi nasabah atas kerugian yang dialami akibat dari penggunaan layanan mobile banking serta untuk mengetahui bagaimana upaya penyelesaian hukum akibat terjadinya kerugian karena tindakan pembobolan dana nasabah melalui layanan mobile banking. Metode penelitian yang digunakan oleh penulis dalam penelitian ini adalah metode penelitian normatif empiris yaitu berkaitan dengan analisis implementasi ketentuan hukum normatif (regulasi perundang-undangan) dan dikaitkan dengan dukungan data-data lapangan yang didapatkan dari hasil wawancara dengan narasumber terkait dengan permasalahan penelitian. Metode pengumpulan data penelitian dilakukan melalui studi lapangan (field research) dan studi pustaka (library research) yaitu melakukan penelitian dengan cara studi di perpustakaan melalui referensi bacaan dalam bentuk buku, artikel, maupun jurnal hukum serta melalui hasil wawancara yang kemudian digunakan sebagai bahan untuk menghasilkan kesimpulan yang menjawab permasalahan penelitian. Sedangkan analisis data yang digunakan adalah analisis data kualitatif, yaitu mengumpulkan, menganalisis dan menginterpretasi data primer dan data sekunder yang tersusun secara sistematis, jelas dan terperinci yang kemudian di analisis dengan logika berpikir hukum. Berdasarkan hasil penelitian menunjukkan bahwa pertanggungjawaban dari pihak bank dan lembaga pemerintahan terhadap kerugian yang dialami oleh nasabah, idealnya akan dikaitkan dengan pembuktian kerugian berasal dari kesalahan dan/atau kelalaian dari nasabah atau pihak bank. Adapun upaya hukum yang dapat ditempuh nasabah dalam melakukan penyelesaian hukum akibat terjadinya kerugian yang timbul dari penggunaan layanan mobile banking ini yaitu melalui cara litigasi (jalur pengadilan) dan non litigasi (jalur di luar pengadilan). Namun demi terciptanya kepastian hukum perlu dibentuk undang-undang yang mengatur secara khusus, terstruktur, dan komprehensif mengenai perlindungan nasabah, mengharmonisasikan peraturan perundang-undangan yang sudah ada serta memaksimalkan mekanisme yang jelas terkait koordinasi antar penegak hukum untuk menciptakan kepastian hukum. Karena hasil dari penelitian menunjukkan bahwa hingga saat ini masih belum ada peraturan perundang-undangan yang mengatur secara khusus mengenai penggunaan layanan mobile banking, namun dalam tatanan hukum positif di Indonesia terdapat peraturan perundang-undangan yang dapat ditafsirkan sebagai perlindungan hukum bagi nasabah pengguna layanan mobile banking.
