Abstract

“Penelitian ini bertujuan untuk mengkaji Penyebab Pengajuan Keberatan Terhadap Putusan Komisi Pengawas Persaingan Usaha Dialihkan Dari Pengadilan Negeri ke Pengadilan Niaga. Tujuan kedua adalah Proses pengajuan keberatan terhadap putusan Komisi Pengawas Persaingan Usaha pasca diterbitkan Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2021” “Penelitian ini menggunakan metode penelitian penelitian yuridis normatif dengan menggunakan asas-asas hukum, peraturan perundang-undangan dan peraturan pendukung lainnya yang berhubungan dengan penelitian ini serta dengan mempelajari doktrin (pendapat sarjana), buku-buku hukum yang berkaitan sebagai landasan analisis dalam pembuatan penelitian ini dengan tujuan dapat menyelesaikan masalah yang terdapat dalam penelitian ini dan membuat hasil kesimpulan atas penelitian dengan mendasarkan pada hukum positif” “Hasil penelitian dan analisis penelitian secara garis besar adalah Penyebab Pengajuan Keberatan Terhadap Putusan Komisi Pengawas Persaingan Usaha Dialihkan Dari Pengadilan Negeri Ke Pengadilan Niaga adalah karena diterbitkannya Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2021 yang merupakan dampak dari ditetapkannya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja yang mengatur bahwa " Pelaku Usaha dapat mengajukan Keberatan terhadap Putusan Komisi Pengawas Persaingan Usaha (KPPU) kepada Pengadilan Niaga paling lambat 14 (empat belas) hari setelah menerima pemberitahuan putusan KPPU dan Proses pengajuan keberatan terhadap putusan Komisi Pengawas Persaingan Usaha pasca diterbitkan Surat Edaran Mahkamah Agung (SEMA) Nomor 1 Tahun 2021 tentu saja mengalami perubahan dengan dikeluarkannya PERMA Nomor 3 Tahun 2021 tentang Tata Cara Pengajuan dan Pemeriksaan Keberatan terhadap Putusan Komisi Pengawas Persaingan Usaha di Pengadilan Niaga yang merupakan peraturan pengganti atas PERMA Nomor 3 Tahun 2019 tentang Tata Cara Pengajuan dan Pemeriksaan Keberatan terhadap Putusan Komisi Pengawas Persaingan Usaha yang menyebabkan terjadinya perubahan dalam proses pengajuan keberatan terhadap putusan Komisi Pengawas Persaingan Usaha” / This study aims to examine the causes of the filing of objections against the decision of the Business Competition Supervisory Commission transferred from the District Court to the Commercial Court. The second objective is the process of filing an objection to the decision of the Business Competition Supervisory Commission after the issuance of Circular Letter of the Supreme Court (SEMA) Number 1 of 2021” “This study uses a normative juridical research method by using legal principles, legislation and other supporting regulations related to this research as well as by studying doctrine (scholar's opinion), related legal books as a basis for analysis in making this research. with the aim of solving the problems contained in this research and making conclusions on the research based on positive law” “The results of the research and research analysis in general are that the cause of the filing of an objection against the Business Competition Supervisory Commission being transferred from the District Court to the Commercial Court is due to the issuance of the Supreme Court Circular Letter (SEMA) Number 1 of 2021 which is the impact of the enactment of Law Number 11 of 2020 concerning Job Creation, which stipulates that "Business actors may file an Objection to the Decision of the Business Competition Supervisory Commission (KPPU) to the Commercial Court no later than 14 (fourteen) days after receiving notification of the KPPU's decision and the process of filing an objection to the decision of the Business Competition Supervisory Commission after the issuance of the letter. The Circular of the Supreme Court (SEMA) Number 1 of 2021, of course, underwent changes with the issuance of PERMA Number 3 of 2021 concerning Procedures for Filing and Examination of Objections to the Decisions of the Business Competition Supervisory Commission at the Commercial Court which is a substitute regulation for PERMA Number 3 of 2019 concerning Procedures for Filing and Examination of Objections to the Decisions of the Business Competition Supervisory Commission which causes changes in the process of filing objections to the decisions of the Business Competition Supervisory Commission”
