Abstract

The purpose of this study is to describe the provisions of the normative rights of workers due to layoffs after the Copyright Act and describe the considerations of the judges at the Courts of Industrial Relations (PHI). Maja Agung Latexindo in Decision No. 266K/Pdt.Sus-PHI/2022.This research is a normative-empirical legal research, which combines a normative legal approach with the addition of empirical elements in the form of cases in court decisions. The data used are secondary data, in the form of related laws and regulations, copies of court decisions and expert opinions, related legal theories obtained through library research. Data analysis was carried out qualitatively and in the form of sentences to obtain answers to the subject matter. The approach used is a statutory approach and case studies.The results showed that the regulation of labor normative rights due to layoffs after the Copyright Act underwent changes, namely removing and reducing the number of calculations and creating new rights. The rights that have been removed are compensation for entitlements in the form of money for housing, medicine and care by removing Article 156 paragraph (4) letter c of the Manpower Law. The reduced entitlement is the multiplied number of severance pay for most reasons for layoffs, except for reasons of death. The new right created is the provision of compensation money for workers after the PKWT ends. The consideration of the Panel of Judges at the first level stated that the dismissal was because the Plaintiff was qualified to resign in accordance with Article 168 paragraph (1) of the Manpower Law so that he was not given any rights was inappropriate, because it was not supported by evidence that the Plaintiff had been absent for 5 (five) consecutive days and a summons. the work of the Defendant 2 times. The consideration of the judge of cassation on the granting of normative rights for workers who were laid off by the Defendant in Decision No. 226K/Pdt.Sus-PHI/2022 has overturned the Decision of the first level of the PHI, and tried himself by declaring the dismissal because the Plaintiff violated the norms of the Company Regulations, so that sentenced the Defendant to pay severance pay, gratuity and compensation amounting to Rp53,016,064,-. according to Article 52 jo. Article 40 paragraphs (2), (3) and (4) of PP No. 35 of 2021. The cassation panel of judges uses PP No. 35 of 2021, because the lawsuit was filed after this PP was enforced by referring to SE MA No. 5 Year 2021. / Tujuan penelitian ini adalah untuk mengganbarkan ketentuan hak normatif tenaga kerja akibat PHK setelah UU Ciptaker dan menggambarkan pertimbangan hakim PHI terhadap pemberian hak nornatif tenaga kerja akibat diputus hubungan kerjanya oleh PT. Maja Agung Latexindo dalam Putusan No.266K/Pdt.Sus�PHI/2022. Penelitian ini adalah penelitian hukum normatif-empiris, yakni penggabungan antara pendekatan hukum normatif dengan penambahan unsur empiris berupa kasus pada putusan pengadilan. Data yang digunakan data sekunder, berupa peraturan perundang-undangan terkait, Salinan putusan pengadilan dan pendapat ahli, teori hukum terkait yang diperoleh melalui penelitian kepustakaan. Analisis data dilakukan secara kualitatif dan dalam bentuk kalimat untuk memperoleh jawaban tentang pokok permasalahan. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan studi kasus. Hasil penelitian menunjukkan pengaturan hak normatif tenaga kerja akibat PHK setelah UU Ciptaker mengalami perubahan yaitu menghapus dan menurunkan jumlah perhitungannya serta penciptaan hak baru. Hak yang dihapus adalah uang penggantian hak berupa uang pengganti perumahan, perobatan dan perawatan dengan menghapus Pasal 156 ayat (4) huruf c UU Ketenagakerjaan. Hak yang dikurangi adalah angka perkalian uang pesangon untuk sebagian besar alasan PHK, kecuali karena alasan meninggal dunia. Hak baru yang diciptakan adalah pemberian uang kompensasi bagi tenaga kerja setelah PKWT berakhir. Pertimbangan Majelis Hakim tingkat pertama menyatakan PHK karena Penggugat dikualifikasikan mengundurkan diri sesuai Pasal 168 ayat (1) UU Ketenagakerjaan sehingga tidak diberi hak apapun adalah tidak tepat, karena tidak didukung dengan alat bukti Penggugat mangkir selama 5 (lima) hari berturut-turut dan surat panggilan kerja dari Tergugat sebanyak 2 kali. Pertimbangan hakim kasasi atas pemberian hak normatif tenaga kerja yang di PHK oleh Tergugat pada Putusan No.226K/Pdt.Sus�PHI/2022 telah membatalkan Putusan PHI tingkat pertama, dan mengadili sendiri dengan menyatakan PHK karena Penggugat melanggar norma Peraturan Perusahaan, sehingga menghukum Tergugat membayar uang pesangon, uang penghargaan masa kerja dan uang penggantian hak berjumlah Rp53.016.064,-.sesuai Pasal 52 jo. Pasal 40 ayat (2), (3) dan (4) PP No. 35 Tahun 2021. Majelis Hakim kasasi menggunakan PP No. 35 Tahun 2021, sebab gugatan diajukan setelah PP ini diberlakukan dengan berpedoman pada SE MA No. 5 Tahun 2021.
