Abstract

The first purpose of this thesis research on the implementation of Corporate Social Responsibility (CSR) at PT Sawit Asahan Tetap Utuh is intended to find out the procedures for implementing CSR and procedures carried out by PT Sawit Asahan Tetap Utuh in accordance with the provisions of Article 74 of Law Number 40 of 2007 concerning Limited Liability Companies. The second purpose of this thesis research is to find out parties who receive the CSR carried out since 2010-2020 by PT Sawit Asahan Tetap Utuh. This research uses normative-empirical legal research method which combine normative events (laws, studies, and other library sources) and empirical events (social). Data types which used in this research are primary and secondary data that are divided into primary legal materials, secondary legal materials and tertiary legal materials. The data was collected by interview session with PT Sawit Asahan Tetap Utuh team and sources from studies/ books to support the interview results. The research analysis data will be analyze by using deductive methods that processes data from general concept to a specific concept. The results from this thesis research are the implementation procedures of CSR at PT Sawit Asahan Tetap Utuh are carried out in accordance with the provisions contained in the company’s Standard Operational Procedure (SOP) approved by the Director at Annual General Meeting of Shareholders (RUPS). The PT Sawit Asahan Tetap Utuh CSR is carried out by the Human Resources Development (HRD) team and accountable to the company Director. There are mandatory and non-mandatory CSR implementations of PT Sawit Asahan Tetap Utuh. CSR is mandatory if the recipient party has been approved in the RUPS. Meanwhile, CSR is not mandatory if the recipients must go through the proposal submission process before receiving the CSR (the recipients is not listed in on the mandatory recipients on RUPS). Based on the implementation procedure, the CSR recipients of PT Sawit Asahan Tetap Utuh are more focused on the people of Dusun IV Pulau Maria Village, which are the mandatory recipients listed in RUPS because the company considers the people of Dusun IV Pulau Maria Village more affected by the company’s activities. Besides focusing on CSR assistance to the people of Dusun IV Pulau Maria Village, PT Sawit Asahan Tetap Utuh also opens equal opportunities for all Indonesian people to apply for CSR assistance which will be included in the list of non-mandatory CSR recipients. The submission can be made by submitting a proposal to PT Sawit Asahan Tetap Utuh which will determine the amount of assistance and acceptance or cancelation of the submission of assistance to the applicant. / Tujuan pertama dari penelitian skripsi terhadap pelaksanaan Corporate Social Responsibility (CSR) di PT Sawit Asahan Tetap Utuh ditujukan untuk mengatahui tata cara pelaksanaan dan prosedur CSR yang dilaksanakan oleh PT Sawit Asahan Tetap Utuh sesuai dengan ketentuan pasal 74 UU Nomor 40 Tahun 2007 Tentang Perseroan Terbatas. Tujuan kedua dari penelitian skripsi ditujukan untuk mengetahui pihak yang menerima hasil CSR yang dilakukan sejak tahun 2010-2020 oleh PT Sawit Asahan Tetap Utuh. Penelitian skripsi menggunakan jenis metode penelitian hukum normatif-empiris yang menggabungkan unsur normatif (undang-undang, buku, dan sumber pustaka lainnya) dan empiris (sosial). Jenis data yang digunakan berupa data primer dan sekunder yang terbagi atas bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Cara perolehan data dilakukan dengan metode wawancara pada narasumber dari PT Sawit Asahan Tetap Utuh dan studi kepustakaan untuk mendukung hasil wawancara. Analisis data hasil penelitian menggunakan metode deduktif, yang mengolah data dari sebuah konsep umum ke konsep khusus. Hasil penelitian dari penelitian skripsi ini adalah tata cara pelaksanaan dan prosedur pelaksanaan CSR PT Sawit Asahan Tetap Utuh dilaksanakan sesuai dengan ketentuan yang tertera didalam Standard Operational Procedure (SOP) perusahaan yang disahkan oleh Direktur didalam Rapat Umum Pemegang Saham Tahunan (RUPS). CSR PT Sawit Asahan Tetap Utuh dilaksanakan oleh tim Human Resources Development (HRD) dan di pertanggung jawabkan kepada Direktur perusahaan. Pelaksanaan CSR PT Sawit Asahan Tetap Utuh ada yang bersifat wajib dan tidak wajib. CSR bersifat wajib jika pihak penerima telah disahkan dalam RUPS. Sedangkan, CSR bersifat tidak wajib jika pihak penerima diharuskan untuk melalui proses pengajuan proposal sebelum menerima CSR (tidak berada dalam daftar penerima wajib CSR dalam RUPS). Berdasarkan tata cara pelaksanaan, pihak penerima CSR PT Sawit Asahan Tetap Utuh lebih difokuskan kepada masyarakat Dusun IV Desa Pulau Maria, yang mana merupakan penerima wajib dalam RUPS sebab perusahaan menganggap masyarakat Dusun IV Desa Pulau Maria lebih terdampak aktivitas perusahaan. Disamping memfokuskan bantuan CSR kepada masyarakat Dusun IV Desa Pulau Maria, PT Sawit Asahan Tetap Utuh turut membuka kesempatan yang sama bagi seluruh masyarakat Indonesia untuk mengajukan bantuan CSR yang akan termasuk kedalam daftar penerima CSR tidak wajib. Pengajuan tersebut dapat dilakukan dengan mengajukan proposal kepada PT Sawit Asahan Tetap Utuh yang kemudian akan ditentukan besar bantuan/ diterima dan tidak diterimanya penyerahan bantuan kepada pemohon.
