Abstract

Intellectual Property Rights in this era of globalization are beneficial for society and the state. But in Indonesia every year, unfortunately, it never escapes in the fight against copyright infringement. Law enforcement used in the development of the times is always changing from a complaint offense then to an ordinary offense and finally in 2014 it returned to a complaint offense. The complaint offense in the copyright law as law enforcement in copyright infringement itself explains that only the creator and/or copyright holder can prosecute if there is a violation of their creation. This copyright infringement continues to occur regardless of using a complaint offense because it does not create a deterrent effect on copyright violators and is contradictory to the spirit of the copyright law itself, where the protection of the economic rights and moral rights of the creator is not guaranteed. / Hak Kekayaan Intelektual dalam era globalisasi ini bersifat menguntungkan bagi masyarakat dan negara. Tetapi di Indonesia setiap tahunnya, sayangnya tidak pernah lepas dalam memerangi pelanggaran hak cipta. Penegakan hukum yang digunakan dalam perkembangan jaman selalu mengalami perubahan dari delik aduan kemudian ke delik biasa dan pada akhirnya di tahun 2014 kembali lagi menjadi delik aduan. Delik aduan dalam undang- undang hak cipta sebagai penegakan hukum dalam pelanggaran hak cipta sendiri menjelaskan bahwa hanya pencipta dan/atau pemegang hak cipta saja yang dapat melakukan penuntutan apabila terjadi pelanggaran terhadap ciptaannya. Pelanggaran terhadap hak cipta ini tetap marak terjadi terlepas menggunakan delik aduan karena tidak membuat efek jera kepada pelanggar hak cipta dan bersifat kontradiktif dengan semanga undang- undang hak cipta itu sendiri di mana tidak terjaminnya perlindungan hak ekonomi dan hak moral pencipta.
