Abstract

Pada Februari 2020, Pemerintah Indonesia telah membuat keputusan untuk tidak memulangkan warga negara Indonesia (WNI) yang telah terlibat dengan Islamic State of Iraq and Syria (ISIS). Ditambah, pemerintah juga hanya masih mempertimbangkan pemulangan untuk anak-anak WNI eks-ISIS yang dibawah 10 tahun. Melakukan hal tersebut dapat diartikan bahwa pemerintah telah bertindak untuk pencabutan status kewarganegaraan tanpa adanya peradilan. Dengan adanya keputusan tersebut, timbullah permasalahan mengenai hak kewarganegaraan dan perlindungan. Skripsi ini membahas mengenai dua topik utama yaitu: (1) hak kewarganegaraan untuk pemulangan anak WNI eks-ISIS, dan (2) perlindungan hukum untuk anak WNI eks-ISIS. Dalam skripsi ini, Penulis membahas bahwa status kewarganegaraan anak-anak WNI eks-ISIS tidak bisa hilang apabila tidak sesuai dengan Pasal 23 Undang-Undang Nomor 12 Tahun 2006 tentang Kewarganegaraan Republik Indonesia dan Pasal 31 Peraturan Pemerintah Republik Indonesia Nomor 2 Tahun 2007 tentang Tata Cara Memperoleh, Kehilangan, Pembatalan, dan Memperoleh Kembali Kewarganegaraan Republik Indonesia. Penulis juga akan membahas pada skripsi ini mengenai perlindungan hukum terhadap anak-anak WNI eks-ISIS yang dapat dianggap sebagai korban jaringan terorisme sesuai dalam Pasal 59 ayat (2) huruf k Undang-Undang Nomor 35 tahun 2014. Mengingat status hak kewarganegaraan dan perlindungan anak-anak eks- ISIS Indonesia yang tidak pasti, penting bagi pemerintah untuk mengambil tindakan, aksi dan langkah-langkah yang diperlukan untuk memastikan bahwa anak-anak ini diberikan hak dan perlindungan yang layak mereka terima. Penting bagi pemerintah untuk memberikan panduan yang jelas tentang hak kewarganegaraan dan perlindungan bagi anak-anak ini, serta sumber daya yang diperlukan untuk memastikan keselamatan dan kesejahteraan mereka. / In February 2020, the Government of Indonesia has decided not to repatriate Indonesian citizens who have been involved with the Islamic State of Iraq and Syria (ISIS). In addition, the government is only considering the repatriation of ex-ISIS Indonesian citizens who are under 10 years old. Doing so can be interpreted that the government has acted to revoke citizenship status without trial. With this decision, problems arose regarding citizenship rights and protection. This thesis discusses two main topics, namely: (1) citizenship rights for the repatriation of ex- ISIS Indonesian citizens, and (2) legal protection for ex-ISIS Indonesian citizens. This thesis discusses the citizenship status of ex-ISIS Indonesian citizens cannot be lost if it is not in accordance with Article 23 of Law Number 12 of 2006 concerning Citizenship of the Republic of Indonesia and Article 31 of Government Regulation of the Republic of Indonesia Number 2 of 2007 concerning Procedures Obtaining, Losing, Canceling, and Reclaiming Citizenship of the Republic of Indonesia. This thesis will also discuss regarding the legal protection of children of ex-ISIS Indonesian citizens who can be considered victims of terrorism networks in accordance with Article 59 paragraph (2) letter k of Law Number 35 of 2014. Given the uncertainty of status of citizenship and protection for children of Indonesian ex- ISIS, it is important for the government to take actions and steps needed to ensure that these children are given the rights and protection they deserve. It is important for governments to provide clear guidance on citizenship and the protection of these children, as well as the resources needed to ensure their safety and well-being.
