Abstract

Indonesia adalah Negara hukum. Semua yang menyangkut kesejahteraan umum sudah diatur dalam undang-undang dalam bentuk peraturan-peraturan tertulis. Dengan begitu sebuah kepastian hukum untuk seseorang sejahtera hakikatnya telah terjamin oleh konstitusi yang ada di Indonesia. Daerah tertentu, terutama wilayah Kalimantan Barat, banyak sekali orang-orang yang memanfaatkan tanah dan menggunakan tanah berdasarkan Surat Keterangan Tanah yang dikeluarkan oleh Kepala Desa. Untuk mengetahui eksistensi Surat Keterangan Tanah (SKT) sehubungan dengan Pendaftaran tanah.Untuk mengetahui peran Notaris/PPAT dalam rangka pendaftaran tanah guna mendukung Kantor Pertanahan dalam memberikan kepastian Hukum Kepemilikan Hak Atas Tanah. Dalam penelitian ini, Penulis menggunakan metode penelitian yuridis normatif dengan menggunakan data sekunder dengan pendekatan undang-undang. Dengan demikian, meskipun SKT tidak diatur secara tegas kedudukannya dalam sistem pertanahan di Indonesia, karena pada dasarnya SKT bukan merupakan suatu hak atas tanah, namun dalam pendaftaran tanah pertama kali. Jadi, dapat disimpulkan bahwa Notaris memiliki peran dalam pemeliharaan data tanah sehubungan dengan pendaftaran tanah, namun PPAT memiliki peran yang lebih besar karena kewenangan dalam pembuatan akta peralihan hak dan akta pembebanan hak. Surat Keterangan Tanah (SKT) bukan merupakan bukti kepemilikan hak atas tanah, namun bukti penguasaan fisik atas tanah. / Indonesia is a legal country. All matters relating to general finance have been regulated in statutory regulations in the form of written statutory regulations. That way a legal certainty for a million of its essence has been guaranteed by the existing constitution in Indonesia. Special Region, most of West Kalimantan, a lot of people who use land and use land based on the Land Certificate issued by the Village Head. To find out the existence of a Land Certificate (SKT) received by land registration. To find out the role of the Notary / PPAT in the framework of land registration to support the Land Office in providing legal certainty of ownership of land rights. In this study, the author uses the normative juridical research method by using secondary data with a statutory approach. Thus, although SKT is not strictly regulated its position in the land system in Indonesia, because basically SKT is not a right to land, but in the first land registration. So, it can be concluded that the Notary has a role in the maintenance of land data in connection with land registration, but PPAT has a greater role because of the authority in making the deed of transfer of rights and the deed of assignment. Land Certificate (SKT) is not proof of ownership of land rights, but proof of physical control over land.
