Abstract
Distribution of food and beverage products that have expired in minimarkets is inseparable from the role of the Food and Drug Monitoring Agency (BPOM) as stipulated in Presidential Regulation of the Republic of Indonesia No. 80 of 2017 concerning the Drug and Food Control Agency. The case of distribution of expired food and beverage products indicates that the irresponsible business actors in distributing their products have proven to be for the sake of getting quick profits, thus ignoring the health of consumers who consume the products distributed by these business actors. Based on research conducted using Normative-Empirical Legal research using data collection methods in the form of library data studies and interviews as well as inductive methods can make the relationship between researchers and informants open and known and able to explain the background and make and make decisions. Efforts made by BPOM in responding to the handling of cases of distribution of expired food and beverage products will be followed up on products in the form of securing them for a certain time or carrying out on-site destruction. BPOM's follow-up attitude given to business actors is to provide guidance related to the Processed Food Safety Management System to retail facilities or other follow-up in accordance with the conditions at the time of inspection and follow-up guidelines in which business actors found to be distributing expired food and beverage products can also subject to administrative sanctions and criminal sanctions in accordance with applicable regulations
