Abstract

IMPLICATIONS OF VERSTEK DECISION IN TORT DISPUTES” (Analytic Study of Serang District Court Decision Number 25/Pdt.G/2020/PN.Srg). The aim of the research is to find out the settlement of default disputes in the absence of the Defendant and the legal consequences of decision Number. 25/Pdt.G/2020/PN.Srg which was terminated by the Verstek Panel of Judges at theSerang District Court. The type of research that the author uses in this research isnormative research. The author will review the application of civil law and also other laws and regulations that apply in Indonesia regarding the case of imposinga verstek decision in a default dispute at Serang District Court Decision Number 25/Pdt.G/2020/ PN. Srg. In this study using 1 (one) types of data, secondary data (sekunder). The data collection method also uses literature studies and direct interviews with the relevant judges. In research in data analysis used there are 2 (two) types of methods, namely qualitative methods and quantitative methods. Theresults of this study indicate that: Settlement of Default Disputes in Verstek Decisions against civil cases Number: 25/Pdt.G/2020/PN.Srg is a decision that is partly verstek because of the breach of contract committed by the Defendant basedon a previously made agreement whose contents is that the Defendant has promised to state that he is willing and willing to return or pay the loan money to the Plaintiffin installments for 3 (three) years with an installment amount of Rp. 23,996,095.- (twenty three million nine hundred ninety six thousand and ninety five rupiah) for the first installment, and for the second installment up to the 36th (thirty six) installment of Rp. 25,519,542,- (twenty five million five hundred nineteen thousandfive hundred and forty two rupiah) And in the petitum from the plaintiff asked to accept and grant the plaintiff's claim in its entirety, even though at the time of proofthe plaintiff could only show documentary evidence and at the time of the trial the witness from the plaintiff was not present. Punish the Defendant to pay compensation to the Plaintiff in the amount of 3% (three percent) for each month from 12 June 2016 until the Defendant pays all of the Plaintiff's money; Sentencedthe Defendant to immediately vacate the Cilegon Business Square D 29 Pondok Cilegon Indah shophouse which was guaranteed to the plaintiff if he did not returnRp. 3.270,000,000.- (three billion two hundred and seventy million rupiah) to the Plaintiff; Rejecting the Plaintiff's lawsuit other than and the rest and Punish the Defendant to pay court fees in the amount of Rp. 591,000.00, - (five hundred ninetyone thousand rupiah).
