Abstract

Auction is one method of buying and selling process which is carried out by selling goods with the highest bid. In Indonesia, many auctions have been carried out offline and online using social media such as Instagram. In Indonesia, the use of internet media in implementation, one of which is auctions through situations, applications, even social media. The provisions legal recognizing online auctions and e-auction have been known since the issuance of the Minister of Finance Regulation Number 213/PMK.06/2020 but have not specifically regulated the provisions regarding online auction rules on social media Instagram which makes its validity questionable. The large number of people who can access Instagram and who are unfamiliar with recognizing auctions are vulnerable to being tempted totakepartinthisonlineauction. Eventhoughtheystilldon'tunderstandthelong- term consequences and impacts of online auctions on the legitimacy and legal protection that can be provided if the auction winner suffers a loss. Therefore, this study has a formulation of the problem (1) How do you regulate the validity of onlineauctionsonsocialmedia? (2)Whatisthelegalprotectionforonlineauction winners who experience losses? The method used by the author in writing this thesis is to use normative legal research methods with a statutory approach. The results of this study show the conclusion that online auctions on Instagram social media as long as they comply with the Minister of Finance Regulation Number 213/PMK.06/2020. online auctions carried out by auction applications that are not auction halls such as Instagram social media are invalid or do not meet the legality of auction law. Where the elements of online auctions are that there must be an Auction Hall, Auction Officials and Minutes of online auction elements, there must be an auction hall, auction official and minutes of auction. Legal protection for auctioneers who experience losses from bankruptcy are provided with preventive legal protection, namely with aid from PMK Number 213/PMK.06/2020 providing provision for provisions regarding auction administrators. Then, protecting the law in a repressive manner, namely by proposing to violate the law.
