Abstract

Pada jaman yang telah modern ini hutang tidak hanya berlangsung secara konvensional namun hutang juga dapat dilangsungkan secara online. Cash Maju merupakan salah satu Aplikasi Fintech Lending yang menawarkan hutang piutang secara online. Dalam pelaksanaan praktik hutang piutang online hendaknya sesuai dengan ketentuan POJK Nomor 10 Tahun 2022. Pengumpulan data dilakukan dengan cara meneliti bahan pustaka atau bahan sekunder. Pendekatan yang dijalankan adalah melalui Undang-Undang (statute approach) dengan menelaah setiap Undang-Undang dan regulasi yang berkaitan, serta melalui pendekatan konseptual (conceptual approach) yaitu pendekatan yang dilakukan dengan melilat doktrin dari para ahli hukum yang terdapat dalam literatur. Hasil analisis dari tugas akhir ini menunjukan bahwa pendirian pinjaman online seharusnya memperoleh izin usaha dari OJK sesuai ketentuan Pasal 8 POJK Nomor 10 Tahun 2022. Cash Maju adalah aplikasi pinjam meminjam uang ilegal dan dapat dikenakan PMH dalam Pasal 1365 KUH Perdata. Perjanjian antara Cash Maju dan debitur Asep Sunandar adalah perjanjian yang tidak sah karena melanggar syarat ke empat dari 1320 KUH Perdata. Tindakan Cash Maju yang menyebarkan data pribadi Asep Sunandar adalah pencemaran nama baik sebagaimana dalam Pasal 27 UU ITE sehingga Asep Sunandar mendapatkan perlindungan hukum dari UU ITE. / In this modern era, debt is not only held conventionally but debt can also be held online. Cash Maju is one of the Fintech Lending Applications that offers accounts receivable online. In the implementation of online accounts receivable practices, it should be in accordance with the provisions of POJK Number 10 of 2022. Data collection is carried out by researching library materials or secondary materials. The approach taken is through the Law (statute approach) by examining each related Law and regulation, and through a conceptual approach (conceptual approach), which is an approach carried out by looking at the doctrines of legal experts contained in the literature. The results of the analysis of this final project show that the establishment of online loans should obtain a business license from the OJK in accordance with the provisions of Article 8 of POJK Number 10 of 2022. Cash Maju is an illegal lending and borrowing application and can be subject to PMH in Article 1365 of the Civil Code. The agreement between Cash Maju and debtor Asep Sunandar is an invalid agreement because it violates the fourth condition of 1320 of the Civil Code. Cash Maju's action of disseminating Asep Sunandar's personal data is defamation as stated in Article 27 of the ITE Law so that Asep Sunandar gets legal protection from the ITE Law.
