Abstract

Pandemi muncul karena penyakit COVID-19 yang membuat masyarakat memakai dan mengoptimalkan potensi serta sumber daya yang mereka miliki melalui perkembangan digital. Salah satunya melalui Tiktok sebagai salah satu bentuk komunikasi untuk berbagi informasi dengan cepat.Namun, Tiktok mempunyai dampak dan pengaruh yang merugikan penggunaannya seperti mencari ketenaran dan keuntungan (profit) pribadi sampai melakukan penyimpangan dan melanggar norma- norma yang sudah berlaku sebagai salah satu bentuk pelanggaran UU ITE. Salah satu contoh kasus yang telah terjadi yaitu Konten nenek mandi lumpur melalui live TikTok yang berlangsung di Lombok Tengah, Nusa Tenggara Barat. Permasalahan yang diangkat dalam penelitian ini adalah Apakah pemegang akun live streaming nenek pengemis bisa dijerat pidana menurut hukum positif di Indonesia. Penelitian ini ditulis bertujuan untuk mengetahui dan lebih memahami penerapan sistem hukum yang berlaku di Indonesia terhadap pemegang akun live streaming nenek pengemis dan melakukan analisis tentang sanksi hukum terhadap pemegang akun live streaming nenek pengemis sesuai hukum yang berlaku di Indonesia. Jenis penelitian yang digunakan adalah Yuridis Normatif dengan menggunakan bahan hukum primer dan hukum sekunder. Kesimpulan dari hasil penelitian ini adalah nenek pemeran dapat dikategorikan sebagai tindak eksploitasi dan dapat dikenakan sanksi pidana sesuai dengan Pasal 2 ayat (1) UU 21/2007. / The pandemic emerged because of the COVID-19 disease which made people use and optimize their potential and resources through digital development. One of them is through Tiktok as a form of communication to share information quickly. However, Tiktok has adverse impacts and influences on its use, such as seeking fame and profit (profit) personal to committing deviations and violating existing norms as a form of violation of the ITE Law. One example of a case that has occurred is the content of a grandmother taking a mud bath throughlive TikTok which took place in Central Lombok, West Nusa Tenggara. The problem raised in this study is whether the account holderlive streaming Beggar grandmothers can be criminally charged according to positive law in Indonesia. This research was written aiming to find out and better understand the application of the legal system that applies in Indonesia to account holders live streaming beggar grandmother and conduct an analysis of legal sanctions against account holderslive streaming beggar grandmother in accordance with applicable law in Indonesia. The type of research used is Normative Juridical using primary legal materials and secondary law. The conclusion from the results of this study is that grandmother actors can be categorized as acts of exploitation and can be subject to criminal sanctions in accordance with Article 2 paragraph (1) of Law 21/2007.
