Abstract

Narkotika adalah jenis kejahatan yang sangat berbahaya bagi kesehatan. Dalam tindak pidana kejahatan narkotika ini pelaku tidak pandang usia, baik dai kalangan orang dewasa, remaja, hingga anak-anak. Perlindungan dari berbagai dampak negatif dari penyalahgunaan narkotika, psikotropika, dan zat adiktif lainnya, mengingat anak sebagai bagian yang tidak terpisahkan dari keberlangsungan hidup manusia, bangsa dan negara. Penerapan sanksi yang dijatuhkan dalam perkara tindak pidana anak dilaksanakan dengan mengacu pada Undang Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. substansi yang paling mendasar dalam UU SPPA ini adalah pengaturan secara tegas mengenai diversi. Diversi adalah pengalihan penyelesaian perkara anak dari proses peradilan pidana ke proses di luar peradilan pidana. Diversi pada hakikatnya juga mempunyai tujuan agar anak terhindar dari dampak negatif penerapan pidana. Penelitian ini bertujuan untuk mengetahui bagaimana penerapan hukum bagi anak yang menjadi pelaku tindak pidana kurir narkotika. Penelitian menggunakan pendekatan statute approach atau juga dapat diartikan sebagai pendekatan dengan perundang-undangan yang ada / Narcotics are a type of crime that is very dangerous for health. In this crime of narcotics, the perpetrators do not look at age, both among adults, teenagers and children. Protection from various negative impacts from the abuse of narcotics, psychotropics and other addictive substances, considering that children are an integral part of the survival of humans, the nation and the state. The application of sanctions imposed in cases of juvenile offenses is carried out with reference to Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. the most basic substance in the SPPA Law is strict regulation regarding diversion. Diversion is the transfer of settlement of child cases from the criminal justice process to processes outside of criminal justice. Diversion in essence also has a goal so that children avoid the negative effects of criminal application. This study aims to find out how the law is applied to children who become perpetrators of narcotics courier crimes. The research uses a statute approach or can also be interpreted as an approach to existing legislation.
