Abstract

Penelitian ini dibuat untuk mengetahui prosedur pelaksanaan tugas Satpol PP dalam menegakkan Perda serta menjaga ketertiban umum dan memahami perlindungan hukum dan Hak Asasi Manusia pada PKL yang di atur dalam undangundang khususnya permasalahan yang terjadi pada PKL di kecamatan Banyumas. Rumusan masalah dalam penelitian ini adalah apakah tindakan pengusiran paksa terhadap PKL yang dilakukan oleh satpol PP merupakan pelanggaran HAM. Penelitian ini bertujuan untuk menegakkan Perda antara PKL dan Satpol PP yang berkaitan dengan HAM yang terjadi di kecamatan Banyumas. Penelitian ini menggunakan metode yuridis normatif. Simpulan dalam penelitian ini adalah kasus yang terjadi di Kecamatan Banyumas para PKL menjadi korban atas tindakan pengusiran oleh Satpol PP yang dimana hal tersebut merupakan tindakan yang melanggar HAM. Oleh karena itu PKL dapat meminta pertanggungjawaban atas apa yang terjadi kepada Komnas HAM. Untuk mengatasi hal-hal tersebut tidak terjadi lagi maka perlu adanya koordinasi dari pemerintah daerah, para PKL dan juga Satpol PP untuk dibuatkan Perda yang mengatur tentang keberadaan PKL dalam melakukan aktivitas dan retribusi untuk para PKL yang dapat dikenakan. / This research was made to find out the procedures for carrying out Satpol PP duties in enforcing regional regulations and maintaining public order and understanding legal protection and human rights for street vendors which are regulated in the law, especially the problems that occur with street vendors in the Banyumas sub-district. The formulation of the problem in this study is whether the forced eviction of street vendors by Satpol PP constitutes a violation of human rights. This study aims to enforce local regulations between street vendors and Satpol PP relating to human rights that occur in the Banyumas sub-district. This study uses a normative juridical method. The conclusion in this study is that in the case that occurred in Banyumas District, street vendors were victims of the eviction by the Satpol PP, which was an act that violated human rights. Therefore, street vendors can hold Komnas HAM accountable for what happened. To prevent these things from happening again, there is a need for coordination from the local government, the street vendors and also the Satpol PP to make a regional regulation that regulates the presence of street vendors in carrying out activities and fees for street vendors that can be imposed.
