Abstract

Penelitian ini membahas tentang praktek investasi ilegal di Indonesia yang masih menjadi ancaman serius bagi investor, terutama mereka yang menjadi korban dari praktek investasi ilegal. Dalam hal ini, perlindungan hukum sangat penting untuk memastikan hak-hak korban terlindungi dan pelaku investasi ilegal dapat dihukum secara tegas. Dalam tinjauan yuridis ini, penulis mengkaji peraturan perundang-undangan di Indonesia terkait investasi ilegal dan perlindungan hukum bagi investor korban. Penulis juga mengeksplorasi sanksi yang diberikan kepada pelaku investasi ilegal dan apakah sanksi tersebut telah efektif dalam mencegah praktik investasi ilegal. Serta perlindungan hukum terhadap investor yang menjadi korban dari praktek investasi ilegal di Indonesia telah diatur dalam beberapa peraturan perundang-undangan. Hasil kajian menunjukkan bahwa meskipun terdapat perlindungan hukum bagi investor korban, tetapi masih banyak tantangan dalam penegakan hukum terhadap praktik investasi ilegal. Oleh karena itu, perlu adanya penegakan hukum yang tegas dari OJK dan pemerintah serta pemahaman yang lebih baik dari masyarakat terkait bahaya investasi ilegal. Penelitian ini menggunakan tipe penelitian Yuridis-Normatif dimana pendekatan terhadap pengolahan bahan hukum dilakukan dengan cara studi Pustaka. Dengan demikian pendekatan yuridis-normatif dalam penelitian digunakan untuk menganalisis kewenangan pemerintah dalam menindak praktek kegiatan investasi ilegal yang terjadi di Indonesia. This study discusses the practice of ilegal investment in Indonesia, which remains a serious threat to investors, especially those who become victims of ilegal investment practices. In this case, legal protection is crucial to ensure that the rights of victims are protected and ilegal investment actors can be punished firmly. In this juridical review, the author examines the regulations in Indonesia related to ilegal investment and legal protection for investor victims. The author also explores the sanctions imposed on ilegal investment actors and whether these sanctions have been effective in preventing ilegal investment practices. Legal protection for investors who become victims of ilegal investment practices in Indonesia has been regulated in several laws and regulations. The study results show that although there is legal protection for investor victims, there are still many challenges in enforcing the law against ilegal investment practices. Therefore, there is a need for firm law enforcement from the OJK and the government as well as better understanding from the public about the dangers of ilegal investment. This research uses a juridical-normative research type where the approach to processing legal material is done through a literature study. Thus, the juridical-normative approach in this research was used to analyze the government's authority in cracking down on ilegal investment activities that occur in Indonesia.
