Abstract

Penelitian ini akan membahas tentang trading in influence dan penegakan hukumnya di Indonesia. Trading in influence sendiri dikategorikan sebagai korupsi dalam Pasal 18 UNCAC. Trading in influence sendiri merupakan praktik yang melibatkan seseorang yang memiliki pengaruh atau akses ke orang-orang yang memiliki kekuasaan dan menggunakan pengaruh tersebut untuk mempengaruhi keputusan atau tindakan yang menguntungkan pemberi suap atau pemilik kepentingan. Indonesia hingga saat ini ini belum mengkriminalisasi trading in influence dalam hukum nasionalnya meskipun telah meratifikasi United Nations Convetion Against Corruption (UNCAC) melalui Undang-Undang Nomor 7 Tahun 2006. Hal ini tentunya akan berdampak pada penegakan hukum serta upaya pemberantasan tindak pidana korupsi khususnya terkait dengan trading in influence yang pada faktanya juga terjadi di Indonesia mengingat dalam hukum pidana dikenal adanya asas legalitas/ This research will discuss about trading in influence and its law enforcement in Indonesia. Trading in influence is categorized as corruption under Article 18 of the UNCAC. Trading in influence involves a person who has influence or access to people in power and uses that influence to influence decisions or actions that benefit the giver of the bribe or stakeholders. Until now, Indonesia has not criminalized trading in influence in its national law, despite having ratified the United Nations Convention Against Corruption (UNCAC) through Law Number 7 of 2006. This will certainly have an impact on law enforcement and efforts to eradicate corruption, especially related to trading in influence, which in fact also occurs in Indonesia, given that criminal law is based on the principle of legality.
