Abstract

Indonesia has a prohibition on ownership of freehold land by foreigners. Foreign citizens who are domiciled in Indonesia and want to obtain land rights can obtain a right of use with a period of time. In the obtaining of Use Rights on Freehold land, it is necessary to have the role of a Land Deed Official as a public official who is authorized to make deeds. This research uses Empirical Normative Legal Research. This research prioritizes Secondary Data, which then is supported by Primary Data, in the form of interviews with sources, namely the Coordinator of the Substance Group for Determination of Land and Space Rights of the Land Office and the Land Deed Official. From this research, it is known that foreign citizens who want to apply for the Right to Use on Freehold land must prepare predetermined requirements, namely immigration documents in the form of visas, passports or residence permits and then proceed with the stage of application for rights, the stage of land inspection, the stage of registration of rights, and the obtaining stage. In addition, it is known that the role of the Land Deed Official is very important and crucial in the application of the Right of Use on Freehold land in order to achieve legal certainty. / Di Indonesia terdapat larangan kepemilikan tanah Hak Milik oleh orang asing. Warga Negara Asing yang berkedudukan di Indonesia dan ingin memperoleh Hak Atas Tanah dapat memperoleh Hak Pakai dengan jangka waktu. Dalam perolehan Hak Pakai di atas tanah Hak Milik perlu adanya peran Pejabat Pembuat Akta Tanah sebagai pejabat umum yang diberikan kewenangan untuk membuat akta. Dalam penelitian ini menggunakan Penelitian Hukum Normatif Empiris. Penelitian ini mengutamakan Data Sekunder, yang kemudian didukung dengan Data Primer, berupa interview dengan narasumber yaitu Koordinator Kelompok Substansi Penetapan Hak Tanah dan Ruang Kantor Pertanahan dan Pejabat Pembuat Akta Tanah. Dari penelitian ini dapat diketahui bahwa bagi Warga Negara Asing asing yang ingin memohonkan Hak Pakai di atas tanah Hak Milik harus menyiapkan syarat yang telah ditentukan, yaitu dokumen keimigrasian berupa visa, paspor atau izin tinggal lalu dilanjutkan dengan tahap permohonan hak, tahap pemeriksaan tanah, tahap pendaftaran hak, dan tahap perolehan. Selain itu diketahui bahwa peran Pejabat Pembuat Akta Tanah sangat penting dan krusial dalam permohonan Hak Pakai di atas tanah Hak Milik demi tercapainya kepastian hukum.
