Abstract

Notaris merupakan profesi hukum yang dapat menghasilkan produk-produk hukum yang salah satunya adalah Akta Autentik. Akta autentik merupakan dokumen resmi yang telah mendapatkan legalitas dari pihak berwenang dan memiliki kekuatan hukum namun bukan berarti Akta Autentik dapat terbebas dari potensi pelanggaran hukum. Notaris yang melanggar peraturan umum, dapat dikenakan sanksi administratif hingga sanksi Pidana. Undang-Undang Jabatan Notaris dan Lembaga yang menaungi Notaris tidak dapat memberikan perlindungan hukum bagi Notaris. Pertanggungjawaban Notaris ialah sanksi pidana dan sanksi administratif. Dalam kasus yang penulis pilih yakni Putusan Mahkamah Agung Peninjauan Kembali Nomor 41/PK/Pid/2021. Pada 13 November 2019, Pengadilan Negeri (PN) Gianyar menyatakan Hartono bersalah turut serta melakukan pemalsuan surat dan menjatuhkan 2 tahun penjara. Pada 21 Januari 2022, Pengadilan Tinggi (PT) Denpasar membalik keadaan dengan membebaskan Hartono. Majelis tinggi menyatakan Hartono bebas murni dan memulihkan martabatnya. Jaksa yang menuntut 5 tahun penjara tidak terima dan mengajukan kasasi. Keadaan kembali berbalik. Hartono kembali dinyatakan bersalah turut serta melakukan pemalsuan surat dan dijatuhi hukuman 4 tahun penjara. Mendapati putusan kasasi itu, notaris hartono tidak terima dan mengajukan PK. Di tingkat paling akhir ini, majelis PK menjatuhkan vonis bebas murni ke Hartono pada 15 September 2021. / Notary is a legal profession that can produce legal products, one of which is an Authentic Deed. An authentic deed is an official document that has received legality from the authorities and has legal force, but that does not mean an authentic deed can be free from potential violations of the law. Notaries who violate general regulations may be subject to administrative sanctions up to criminal sanctions. The Law on the Position of Notaries and Institutions that oversee Notaries cannot provide legal protection for Notaries. Notary liability is criminal sanctions and administrative sanctions. In the case that the author chose, namely the Supreme Court Judicial Review Number 41/PK/Pid/2021. On November 13, 2019, the Gianyar District Court found Hartono guilty of participating in forging letters and sentenced him to 2 years in prison. On January 21, 2022, the Denpasar High Court reversed the situation by acquitting Hartono. The upper house declared Hartono pure freedom and restored his dignity. Prosecutors who demanded 5 years in prison did not accept it and filed an appeal. Things turned around again. Hartono was again found guilty of participating in forging letters and was sentenced to 4 years in prison. Upon receiving the cassation decision, notary Hartono did not accept it and submitted a Judicial Review. At this latest level, the Judicial Review assembly handed down a pure acquittal to Hartono on September 15, 2021.
