Abstract

Dalam dunia industri dan perdagangan, peranan merek sangatlah penting. Dengan adanya merek membuat produk yang dikeluarkan menjadi lebih bernilai, terutama merek terkenal. Merek terkenal adalah aset yang tak ternilai harganya, sehingga menjadi incaran para pelaku usaha untuk melakukan peniruan. Salah satunya adalah sengketa merek dagang terkenal asing 100% yang diajukan ke Pengadilan Niaga pada Pengadilan Negeri Jakarta Pusat, yang terjadi antara Saule, LLC dan Jefrie Permana dibawah Register Nomor 22/Pdt.Sus-HKI/Merek/2021/PN.Niaga.Jkt.Pst. Hal ini dikarenakan Jefrie Permana telah mendaftarkan merek yang sama persis dengan Saule, LLC. Dalam penelitian ini, menggunakan metode penelitian hukum normatif-empiris, cara perolehan data melalui studi kepustakaan dan teknik wawancara, serta pendekatan kasus hukum. Dari hasil penelitian, dapat disimpulkan bahwa pengaturan mengenai perlindungan merek terkenal menurut Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis dapat dilihat pada Pasal 21 ayat (1) huruf b dan c, Pasal 76, dan Pasal 83. Kemudian, Indonesia telah memberikan perlindungan hukum kepada pemilik sah atas merek dagang terkenal asing 100% dengan menyatakan merek 100% milik Saule, LLC sebagai merek terkenal Internasional dan merek terkenal di Indonesia, membatalkan merek 100% terdaftar atas nama Jefrie Permana karena mempunyai persamaan pada keseluruhannya dengan merek 100% milik Saule, LLC serta menyatakan Jefrie Permana memiliki itikad tidak baik. / In the world of industry and commerce, the role of brands is very important. The presence of a brand adds value to the products being released, especially well-known brands. Well-known brands is an invaluable asset, so that well-known brands are sought after by business actors for counterfeiting purposes. One of them is a dispute over a 100% well-known foreign trademark submitted to the Commercial Court at the Central Jakarta District Court, which occurred between Saule, LLC and Jefrie Permana under Register Number 22/Pdt.Sus-HKI/Merek/2021/PN.Niaga.Jkt.Pst. This is because Jefrie Permana has registered an identical trademark to that of Saule, LLC. In this research, used normative-empirical legal research method, data acquisition is done through literature review and interview techniques, as well as a case law approach. From these results, it can be concluded that the regulation regarding the protection of well-known brands according to Law Number 20 of 2016 concerning Trademarks and Geographical Indications can be seen in Article 21 paragraph (1) subparagraphs b and c, Article 76, and Article 83. Furthermore, Indonesia has provided legal protection to the rightful owners of 100% foreign well-known trademarks by declaring Saule, LLC's 100% trademark as an internationally well-known brand and a well-known brand in Indonesia. The registered 100% trademark under the name of Jefrie Permana has been canceled due to its complete similarity with Saule, LLC's 100% trademark, and Jefrie Permana has been declared to have acted in bad faith.
