Abstract

Hak atas tanah dapat beralih, salah satu peralihan dapat dilakukan dengan jual beli. Jual beli tanah harus dituangkan dalam akta autentik, yaitu dengan Akta Jual Beli. Akta Jual Beli tersebut akan menjadi dasar atas peralihan hak atas tanah. Sengketa pertanahan dapat terjadi ketika proses jual beli tidak sesuai dengan prosedur. Pokok permasalahan dalam penulisan ini mengenai akibat hukum Akta Jual Beli sebagai bukti autentik peralihan Sertifikat Hak Milik yang disangkal penjual karena utang piutang. Penulisan ini bertujuan untuk memecahkan permasalahan hukum terhadap Akta Jual Beli ebagai bukti autentik peralihan tanah yang terdapat sangkalan.Jenis penelitian menggunakan penelitian hukum normatif-empiris. Hasil analisis penulis yaitu akta jual beli dibuat berdasarkan adanya perjanjian pengikatan jual beli yang dibuat secara melawan hukum, sehingga perjanjian tersebut menjadi tidak sah dan tidak berkekuatan hukum. Sehingga akibat hukum terhadap akta jual beli tersebut harus dibatalkan, serta peralihan hak atas tanah dan pembebanan hak tanggungan terhadap tanah sengketa juga harus dibatalkan. / Land rights can be transferred, and one of the transfers can be performed by sale and purchase. The sale and purchase of land must be stated in an authentic deed, i.e., the Sale and Purchase Deed. The Sale and Purchase Deed will become the basis for transferring land rights. Land disputes can occur when the sale and purchase process does not follow procedures. The main problem in this writing regards the legal consequences of the Sale and Purchase Deed as authentic proof of the transfer of Property Rights Certificates denied by the seller due to debts. This writing aims to solve legal issues regarding the Sale and Purchase Deed as authentic evidence of land transfers where there are objections. This type of research uses normative�empirical legal research. The analysis result is the deed of sale and purchase was made based on a binding sale and purchase agreement against the law. Hence, the agreement becomes invalid and has no legal force. Therefore, the legal consequences of the sale and purchase deed must be canceled, as well as the transfer of land rights and the imposition of mortgage rights on the disputed land must also be canceled.
