Abstract

“IMPLEMENTATION OF CHEMICAL CASTRATION AGAINST CHILD RAPE PERPETRATORS IN THE INDONESIAN CRIMINAL LAW SYSTEM” (106 pages; 35 pictures) Underage children are highly susceptible to illness and are also extremely traumatized by the sexual abuse they have experienced. This goes both ways in the lives of the victim and the perpetrator because rape victims are psychologically burdened by the event. Through several cases of sexual harassment that were brought to court, the thing that caught the author's attention was the punishment imposed by the judge was not the castration punishment. The majority of the sentences imposed were prison sentences and death sentences. The author then examines how the application of castration punishment in similar cases by setting 2 problem formulations, i.e.: (i) How is the implementation of sanctions against child rapists in Indonesia; and (ii) the application of castration punishment against child rapists in Indonesia. The purpose of the research is to solve the problem of castration punishment against child rapists who are currently not maximized in its application. The writing is conducted with the normative-empirical research method using primary data in the form of laws and conventions of children's rights supplemented by secondary data in the form of journals and the results of previous scientific research. The author uses data acquisition in the form of interview methods and uses the type of legal principles approach, legal systematics and case approaches through judicial decisions containing cases of sexual violence against children. In the research, the author also processes data by analyzing in the form of qualitative data sourced from regulations, legal norms and interviews. This research will ultimately lead to the discovery on the premature castration punishment against child rapists and the required role of medical experts and regulation makers in answering the problem formulation described in the writing later .
