Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisis keabsahan penggunaan tanda tangan elektronik dalam legalisasi dokumen oleh Notaris. Dari penelitian ini, terdapat perbedaan pendapat mengenai kekuatan tanda tangan elektronik dalam legaliasasi dokumen oleh notaris, yang ditandatangani dengan tanda tangan elektronik yang digunakan sebagai alat bukti dipersidangan serta dokumen lainnya. Pemerintah hendaknya segera mengesahkan Peraturan Pemerintah mengenai Tanda Tangan Elektronik dan Peraturan Pemerintah mengenai Sertifikasi Elektronik, sehingga ada aturan hukum lebih lanjut dari Undang-Undang Nomor 11 Tahun 2008. Dokumen elektronik yang telah ditandatangani dengan tanda tangan elektronik, mempunyai daya pembuktian yang sama dengan akta otentik yang dibuat oleh pejabat yang berwenang, setelah dikeluarkan Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik, sedangkan para notaris berpendapat dokumen elektronik yang ditandatangani dengan tanda tangan elektronik, hanya mempunyai kekuatan pembuktian dibawahtangan, karena tidak memenuhi syarat sebagai akta otentik, yaitu tidak menghadap kepada pejabat yang berwenang. Didalam UUJN masih terdapat beberapa syarat mutlak suatu akta otentik sebagaimana terdapat dalam Pasal 16 ayat (1) huruf m bahwa akta notaris harus ditandatangani pada saat itu juga oleh penghadap, saksi dan notaris. Pengaturan norma dan praktik terkait tanda tangan elektronik dalam akta Notaris, di masa yang akan datang. Landasan teori yang dipakai dalam penelitian adalah keadilan, kepastian hukum, dan keabsahan. Jenis penelitian yang penulis gunakan ini adalah penelitian hukum yuridis normatif yang menggunakan pendekatan perundang-undangan dengan meneliti bahan pustaka atau bahan sekunder. Bahan penelitian tesis ini terdiri dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier yang diolah secara analisis sistematis. Analisis bahan penelitian menggunakan penafsiran hukum. Dari hasil penelitian didapat kesimpulan: bahwa Notaris harus atau wajib membacakan akta dihadapan para penghadap atau para pihak. Hal ini membuat pengaturan memiliki potensi kemungkinan terjadi nya perbedaan antara pembacaan dan penanda waktu yang menunjukkan tanggal dan/atau termaksud juga peristiwa tertentu terjadi. Namun seiring dengan perkembangan zaman dan kemajuan teknologi saat ini dapat dimungkinkan untuk dilakukannya legalisasi dokumen elektronik terhadap surat berharga karena hal tersebut akan memberikan kemudahan bagi pihak yang berhadapan dengan Notaris apabila terjadinya suatu keadaan yang tidak dimungkinkan. / The purpose of this study is to determine and analyze the validity of using electronic signatures in document legalization by notaries. From this study, there are differences of opinion regarding the power of electronic signatures in legalizing documents by notaries, which are signed with electronic signatures that are used as evidence in court and other documents. The government should immediately ratify Government Regulations regarding Electronic Signatures and Government Regulations regarding Electronic Certification, so that there are further legal regulations from Law Number 11 of 2008. Electronic documents that have been signed with electronic signatures have the same evidentiary power as authentic deeds. made by authorized officials, after the issuance of Law Number 11 of 2008 concerning Electronic Information and Transactions, while notaries are of the opinion that electronic documents signed with electronic signatures only have the power of proof under the hands, because they do not meet the requirements as an authentic deed, i.e. not before the competent authority. In UUJN there are still several absolute requirements for an authentic deed as contained in Article 16 paragraph (1) letter m that the notary deed must be signed at that time by the appearer, witness and notary. Setting norms and practices related to electronic signatures in Notary deeds, in the future. The theoretical basis used in this research is justice, legal certainty, and validity. The type of research that the authors use is normative juridical legal research that uses a statutory approach by examining library materials or secondary materials. The research materials for this thesis consist of primary legal materials, secondary legal materials and tertiary legal materials which are processed in a systematic analysis. Analysis of research materials using legal interpretation. From the results of the research, it can be concluded that the Notary must or is obliged to read the deed in front of the appearers or the parties. This makes the setting potentially possible for discrepancies between readings and timestamps indicating the date and/or intended certain events to occur. However, along with the times and advances in technology, it is now possible to sign electronic documents on securities because this will make it easier for parties dealing with a Notary in the event of an impossible situation.
