Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisis terkait kepastian hukum sertipikat hasil program pendaftaran tanah sistematis lengkap yang ada di Kabupaten Bintan. Kegiatan pendaftaran tanah melalui program pendaftaran tanah sistematis lengkap dilaksanakan di seluruh Provinsi yang ada di Indonesia secara merata. Tujuan kegiatan pendaftaran tanah ini untuk memberikan kepastian hukum dan perlindungan hukum kepada para pemegang hak atas tanah, selain itu juga untuk mencegah atau mengurangi adanya sengketa tanah pada masyarakat. Kegiatan pendaftaran tanah di Kabupaten Bintan mengalami kendala dikarenakan penerbitan beberapa sertipikat mengalami cacat administrasi dan/atau cacat yuridis sehingga menimbulkan permasalahan di masyarakat. Oleh karena itu penulis mengangkat rumusan masalah bagaimana kepastian hukum terhadap sertipikat hasil program pendaftaran tanah sistematis lengkap di Kabupaten Bintan. Penelitian ini dilakukan dengan metode penelitian hukum empiris, melalui wawancara dengan Kantor Pertanahan Kabupaten Bintan. Bahan utama yang digunakan dalam penelitian ini adalah bahan hukum primer berupa peraturan nasional terkait pendaftaran tanah serta hasil wawancara untuk menganalisis permasalahan yang ada. Penelitian ini memiliki beberapa kesimpulan yaitu : kantor pertanahan telah melaksanakan program pendaftaran tanah sistematis lengkap sesuai dengan peraturan perundang-undangan yang berlaku. Sertipikat yang dihasilkan dari pendaftaran tanah program pendaftaran tanah sistematis lengkap memiliki makna kepastian mengenai hak atas tanah, kepastian data fisik dari objek pendaftaran tanah serta kepastian data yuridis mengenai subjek pendaftaran tanah yaitu pemilik tanah. / This research aims to identify and analyze the legal certainty of certificates resulting from a complete systematic land registration program in Bintan Regency. Land registration activities through a complete systematic land registration program are carried out evenly in all provinces in Indonesia. The purpose of this land registration activity is to provide legal certainty and legal protection to holders of land rights, besides that it is also to prevent or reduce land disputes in the community. Land registration activities in Bintan Regency experienced problems because the issuance of several certificates had administrative and/or juridical defects, causing problems in the community. Therefore the author raises the formulation of the problem of how legal certainty is for certificates resulting from the complete systematic land registration program in Bintan Regency. This research was conducted using empirical legal research methods, through interviews with the Bintan District Land Office. The main materials used in this study are primary legal materials in the form of national regulations related to land registration as well as the results of interviews to analyze existing problems. This study has several conclusions, namely: the land office has implemented a complete systematic land registration program in accordance with the applicable laws and regulations. Certificates resulting from the complete systematic land registration program land registration have the meaning of certainty regarding land rights, certainty of physical data from the object of land registration and certainty of juridical data regarding the subject of land registration, namely the land owner.
